Guidelines on Enforcement of Financial Information

The European Securities and Markets Authority (ESMA) issues these guidelines to establish uniform supervisory practices for the enforcement of financial information under the Transparency Directive across EU and EEA competent authorities. The document defines enforcement procedures, including desktop and interactive examinations, mandates cross-border coordination through the European Enforcers Coordination Sessions, and requires national regulators to report their compliance status to ESMA. By standardizing enforcement methodologies and corrective actions, the guidelines aim to prevent regulatory arbitrage, ensure consistent application of financial reporting frameworks, and strengthen investor confidence in European capital markets.
