Implementation of EBA Guidelines Modifying EBA/GL/2021/02 on Customer Due Diligence and Risk Factors for AML/CFT under Articles 17 and 18(4) of Directive (EU) 2015/849 (EBA/GL/2023/03)

The Prudential Control and Resolution Authority (ACPR) has declared itself compliant with the European Banking Authority's guidelines (EBA/GL/2023/03) regarding customer due diligence and risk factors for money laundering and terrorist financing. These guidelines, which modify the previous EBA/GL/2021/02 document, apply to all credit institutions and financial entities supervised by the ACPR as defined in Directive (EU) 2015/849. The measures must be fully implemented by the deadline of November 3, 2023, in accordance with Regulation (EU) No 1093/2010.

Implementation of the European Banking Authority (EBA) Guidelines Modifying EBA/GL/2021/02 on Customer Due Diligence and the Factors that Credit Institutions and Financial Institutions Should Take into Account When Assessing the Risk of Money Laundering and Terrorist Financing Associated with Individual Business Relationships and Occasional Transactions (the "AML/CFT Risk Factor Guidelines") under Articles 17 and 18, Paragraph 4, of Directive (EU) 2015/849 (EBA/GL/2023/03)

The Prudential Control and Resolution Authority (ACPR) has declared itself compliant with the European Banking Authority (EBA/GL/2023/03) Guidelines modifying EBA/GL/2021/02 on Customer Due Diligence and the Factors that Credit Institutions and Financial Institutions Should Take into Account When Assessing the Risk of Money Laundering and Terrorist Financing Associated with Individual Business Relationships and Occasional Transactions (the "AML/CFT Risk Factor Guidelines") under Articles 17 and 18, Paragraph 4, of Directive (EU) 2015/849. The Guidelines are attached to this Notice.

These Guidelines are applicable as of November 3, 2023, by all credit institutions and financial entities defined in paragraphs 1 and 2 of Article 3 of Directive (EU) 2015/849 of the European Parliament and of the Council of May 20, 2015, and subject to ACPR supervision, who must do everything in their power to comply with them, in accordance with the provisions of Article 16 of Regulation (EU) No 1093/2010 of the European Parliament and of the Council of November 24, 2010, establishing a European Supervisory Authority (European Banking Authority).
