Instruction No. 99-03 of June 22, 1999 on the Teletransmission of Documents Intended for the Banking Commission

The Banking Commission issued Instruction No. 99-03 to mandate the teletransmission of documents to the Commission. This requirement applies immediately to new entities and by March 31, 2000, for credit institutions and investment firms authorized before June 30, 1999. The instruction simultaneously abrogates conflicting provisions from previous instructions 93-01, 94-09, and 97-04.

Instruction No. 99-03 of June 22, 1999 on the Teletransmission of Documents Intended for the Banking Commission

The Banking Commission,

Having regard to Law No. 84-46 of January 24, 1984, as amended, relating to the activity and supervision of credit institutions, particularly Article 40 thereof;

Having regard to Instruction No. 93-01 of January 29, 1993, relating to the transmission to the Banking Commission by credit institutions and financial companies of their annual accounts, prudential documents, and various information, as amended by Instruction No. 95-02 of February 24, 1995;

Having regard to Instruction No. 94-09 of October 17, 1994, relating to documents intended for the Banking Commission, as amended by Instruction No. 97-01 of March 27, 1997;

Having regard to Instruction No. 97-04 of June 19, 1997, relating to the transmission by investment firms of their annual accounts, periodic documents, and various information, as amended by Instructions No. 98-04 of April 10, 1998 and No. 98-06 of May 7, 1998.

Decides:

Article 1

  • Documents transmitted to the Banking Commission must be sent by teletransmission, as of the decree of March 31, 2000, for credit institutions and investment firms authorized before June 30, 1999, and immediately for others.

Article 2

  • All provisions contrary to the preceding article, contained in the Banking Commission's Instructions No. 93-01, No. 94-09, and No. 97-04 mentioned above, are repealed upon the entry into application of the provisions of this Instruction.
