Joint Instruction No. 1 - Discloses Procedures for Remitting Financial Statements by Institutions in Extrajudicial Liquidation Regime

The Heads of the Resolution and Sanctioning Department (Derad) and the Financial System Monitoring Department (Desig) of the Central Bank of Brazil issued Joint Instruction No. 1 to establish procedures for financial reporting by institutions under extrajudicial liquidation. The instruction mandates the submission of two specific documents, the Special Balance Sheet of Substitute Liquidator (Code 4090) and the Opening Balance Sheet of the Extrajudicial Liquidation Regime (Code 4096), using defined Cosif accounting plans. Submissions must be made electronically via the STA system within sixty days of the respective base dates, subject to entry validation checks, and this instruction revokes Circular Letter No. 3,810 of 2017.

The Head of the Resolution and Sanctioning Department (Derad) and the Head of the Financial System Monitoring Department (Desig), in the exercise of the authority conferred upon them by Article 23, item I, letter "a", of the Internal Regulations of the Central Bank of Brazil, annexed to Ordinance No. 84,287 of February 27, 2015, based respectively on Articles 94-A, item I, and 77, item III, of the aforementioned Regulations, and considering the provisions of BCB Resolution No. 13 of September 9, 2020,

RESOLVE:

Article 1. The financial statements referred to in Article 15 of BCB Resolution No. 13 of September 9, 2020, must be remitted to the Central Bank of Brazil by institutions under the extrajudicial liquidation regime decreed by this Autarchy, through the documents with the codes specified below, in accordance with the annex to this Instruction:

I - 4090 - Special Balance Sheet of Substitute Liquidator; and

II - 4096 - Opening Balance Sheet of the Extrajudicial Liquidation Regime.

Article 2. The institutions referred to in Article 1 must use the accounting titles provided in the Chart of Accounts of Institutions of the National Financial System (Cosif) intended for companies in extrajudicial liquidation, whereby:

I - document code 4090 must be prepared based on the accounting plan of document code 4010; and

II - document code 4096 must be prepared based on the accounting plan of document code 4016.

Article 3. The remittance of the documents mentioned in Article 1 may only be carried out after the institution certifies that there will be no impediment to their reception due to entry validations, according to the Quality Process Systematic available on the Central Bank of Brazil's website at https://www.bcb.gov.br/estabilidadefinanceira/sistemacosif.

Article 4. Circular Letter No. 3,810 of March 15, 2017, is hereby revoked.

Article 5. This Instruction enters into force on September 1, 2021.
