Bank Indonesia Circular Letter Number 13/3/DPM dated February 4, 2011 concerning Commercial Bank Daily Report

Summary

:

The Reporting Bank shall consist of head offices of a bank incorporated as an Indonesian Legal Entity, namely:

a.

Head office of a Bank conducting business activities on a conventional basis;

b.

Head office of a Bank conducting business activities based on sharia principles;

c.

Foreign Bank’s Branch Office; and

d.

Sharia Business Unit.

Types of data which must be submitted by the Reporting Bank shall consist of:

a.

Transactional Data, namely: data on Interbank Money Market (PUAB), data on Sharia Interbank Money Market (PUAS), data on securities trade in the secondary market and foreign exchange transactions.

b.

Non-Transactional Data, namely: end-of-day position of non-investment foreign exchange sale derivative transaction with foreign party, end-of-day position of non-investment foreign exchange purchase derivative transaction with foreign party, recapitulation position of derivative transactions, net open position, certain accounts of balance sheet, cash flow projection, rate of return on mudharabah investment deposit of sharia Bank, prime lending rate, lending rate, time deposit interest rate, discount certificate of deposit and savings interest rate, offer interest rate, daily balance position of Bank short-term offshore loan and daily business funds position of foreign bank's branch office.

Types of data forms which must be submitted by the Reporting Bank shall consist of:

a.

For transactional data on Commercial Bank Daily Report (LHBU), it is submitted by using the following types of forms:

Form 101 (Interbank Money Market);

Form 102 (Sharia Interbank Money Market);

Form 201 (Tod/Tom/Spot Transaction);

Form 202 (Forward/Swap/Option Transaction);

Form 203 (Other Derivative Transactions); and

Form 301 (Securities trade in the secondary market)

b.

For non-transactional data on LHBU, it is submitted by using the following types of forms:

Form 204 (End-of-Day Position of Non-Investment Foreign Exchange Sale Derivative Transaction with Foreign Party);

Form 205 (End-of-Day Position of Non-Investment Foreign Exchange Purchase Derivative Transaction with Foreign Party);

Form 206 (Recapitulation of Derivative Transactions);

Form 401 (Consolidated NOP of Domestic Offices);

Form 402 (Consolidated NOP of Domestic and Overseas Offices);

Form 403 (Certain Accounts of Consolidated Balance Sheet of Domestic Offices);

Form 404 (Certain Accounts of Consolidated Balance Sheet of Domestic and Overseas Offices);

Form 405 (Report on Rupiah Cash Flow Projection);

Form 406 (Report on Foreign Exchange Cash Flow Projection);

Form 407 (Report on Daily Balance of Bank Short-Term Offshore Loan);

Form 408 (Report on Daily Business Funds Position of Foreign Bank’s Branch Office);

Form 501 (Offer Interest Rate);

Form 601 (Prime Lending Rate);

Form 602 (Lending Rate);

Form 603 (Time Deposit Interest Rate, Savings Interest Rate and Discount Certificate of Deposit); and

Form 604 (Rate of Return on Mudharabah Investment Deposit of Sharia Bank);

The Reporting Bank shall submit LHBU online. In the event of technical problems in the Reporting Bank or Bank Indonesia, LHBU shall be submitted offline.

The time limit for the submission of LHBU shall be determined as follows:

a.

At 07.00 Western Indonesia Time up to 10.30 Western Indonesia Time for data on offer interest rate in Rupiah and foreign exchange.

b.

At 07.00 Western Indonesia Time up to 12.00 Western Indonesia Time for data on Rupiah Interbank Money Market - morning session.

c.

At 12.01 Western Indonesia Time up to 18.00 Western Indonesia Time for data on Rupiah Interbank Money Market - afternoon session.

d.

At 07.00 Western Indonesia Time up to 18.00 Western Indonesia Time for the following data:

foreign exchange Interbank Money Market;

Sharia Interbank Money Market;

securities trade in the secondary market;

rate of return on mudharabah investment deposit of sharia Bank in Rupiah;

prime lending rate in Rupiah and foreign exchange (USD);

lending rate in Rupiah and foreign exchange (USD); and

time deposit interest rate in Rupiah and foreign exchange (USD), discount certificate of deposit in Rupiah and foreign exchange (USD) as well as savings interest rate in Rupiah.

e.

At 07.00 Western Indonesia Time up to 23.59 Western Indonesia Time for the following data:

foreign Interbank Money Market;

foreign exchange transaction;

end-of-day position of non-investment foreign exchange sale derivative transaction with foreign party;

end-of-day position of non-investment foreign exchange purchase derivative transaction with foreign party;

recapitulation position of derivative transactions;

net open position;

certain accounts of balance sheet;

cash flow projection;

daily balance position of Bank short-term offshore loan; and

daily business funds position of foreign bank’s branch office.

The time Limit for Correcting LHBU shall be determined as follows:

a.

The data on offer interest rate shall be corrected by no later than 11.00 Western Indonesia Time on the same business day.

b.

In the event of errors in the data submitted:

Rupiah Interbank Money Market - morning session;

Rupiah Interbank Money Market - afternoon session;

foreign exchange Interbank Money Market;

Sharia Interbank Money Market;

securities trade in the secondary market;

NOP of Consolidated domestic offices;

NOP of Consolidated domestic and overseas offices

certain accounts of Consolidated balance sheet of domestic offices

certain accounts of Consolidated balance sheet of domestic and overseas offices

Rupiah cash flow projection;

foreign exchange cash flow projection;

rate of return on mudharabah investment deposit of sharia Bank in Rupiah;

prime lending rate in Rupiah and foreign exchange (USD);

lending rate in Rupiah and foreign exchange (USD); and

time deposit interest rate in Rupiah and foreign exchange (USD), discount certificate of deposit in Rupiah and foreign exchange (USD) as well as savings interest rate in Rupiah.

The Reporting Bank must submit the correction immediately after an error has been found and still within the time limit for the submission on the same business day.

c.

In the event of errors in the data submitted:

foreign Interbank Money Market;

tod/tom/spot transaction;

derivative transaction in the form of forward, swap, option;

other derivative transactions;

end-of-day position of non-investment foreign exchange sale derivative transaction with foreign party;

end-of-day position of non-investment foreign exchange purchase derivative transaction with foreign party;

recapitulation position of derivative transactions;

daily balance position of Bank short-term offshore loan; and

daily business funds position of foreign bank’s branch office.

The Reporting Bank must submit the correction to the intended data by no later than 16.00 Western Indonesia Time on the succeeding business day.

In the event of technical problems and force majeure, the reporting shall be submitted offline with the following provisions:

a.

For the reporting of data on Interbank Money Market, Sharia Interbank Money Market, securities trade in the secondary market, prime lending rate, lending rate, time deposit interest rate, savings interest rate, discount certificate of deposit, rate of return on mudharabah deposit of sharia bank, they shall be submitted by no later than 2 hours following the time limit for reporting.

b.

For the data on foreign Interbank Money Market, foreign exchange transaction, derivative transaction, other derivative transactions, end-of-day position of non-investment foreign exchange sale derivative transaction with foreign party, end-of-day position of non-investment foreign exchange purchase derivative transaction with foreign party, recapitulation position of derivative transactions, NOP of Consolidated domestic offices, NOP of Consolidated domestic and overseas offices, certain accounts of Consolidated balance sheet of domestic offices, certain accounts of Consolidated balance sheet of domestic and overseas offices, Rupiah cash flow projection, foreign exchange cash flow projection, daily balance position of Bank short-term offshore loan and daily business funds position of Foreign Bank’s Branch Office, they shall be submitted by no later than 10.00 Western Indonesia Time on the succeeding business day.

c.

For the data on or the corrected data on offer interest rate, it shall be submitted by no later than 11.00 Western Indonesia Time on the same Business Day.

In the event that the Reporting Bank has not submitted LHBU or corrected LHBU following the time limit for the submission of LHBU/correction to LHBU, the Reporting Bank shall remain to be obligated to submit the following data on LHBU online:

a.

by no later than 1 (one) hour following the time limit for the submission of the correction online, for the data on Rupiah Interbank Money Market - morning session, Rupiah Interbank Money Market - afternoon session, foreign exchange Interbank Money Market and Sharia Interbank Money Market.

b.

by no later than 16.00 Western Indonesia Time within 5 (five) business days following the date of correction to the report for data on NOP, certain accounts of balance sheet, cash flow projection, foreign exchange transaction, end-of-day position of non-foreign investment foreign exchange sale and purchase derivative transaction, recapitulation position of derivative transactions, daily balance position of bank short-term offshore loan; and daily business funds position of foreign bank’s branch office.

Outputs from Commercial Bank Daily Report (LBHU) shall be in the form of aggregate data and individual data on the Reporting Bank.

The outputs from Commercial Bank Daily Report (LBHU) shall include JIBOR data, namely interest rate of Interbank Money Market transaction offer in Indonesia derived from data on offer the interest rate of the Reporting Banks determined by Bank Indonesia as JIBOR contributors.

Bank Indonesia shall provide outputs from Commercial Bank Daily Report (LBHU) to the Reporting Banks and LHBU Subscribers.

As a requirement to become a LHBU Subscriber, the prospective LHBU Subscriber shall submit a request in writing to Bank Indonesia, and if it is approved, it shall sign the Agreement on the Use of LHBU.

Bank Indonesia shall provide access right to LHBU system to the Reporting Banks and LHBU Subscribers. A fee shall not be charged for a certain number of access rights to Reporting banks, while a fee shall be charged for the right of access and information to LHBU subscribers.

A violation of LHBU reporting shall be subject to sanctions in the form of financial penalty and/or written reprimand.
