Decree No. 2008-446 of May 5, 2008 on the Appointment of Members of the Banking and Financial Supervision Commission (CSBF)
The First Minister of Madagascar issued Decree No. 2008-446 to appoint three individuals—Mrs. RALIJOHN Nirina Emma, Mr. RALIJAONA Andry, and Mr. RAKOTOARIMANANA Victor—to the Banking and Financial Supervision Commission (CSBF) for a three-year term. The decree simultaneously repeals the prior appointment decree of March 8, 2005, while retaining five ex officio members such as the Central Bank Governor and Treasury Director General. Execution of these appointments is assigned to the Minister of Finance and Budget and the Central Bank Governor, who must ensure publication in the Official Journal.
DECREE NO. 2008-446 OF MAY 5, 2008 ON THE APPOINTMENT OF MEMBERS OF THE BANKING AND FINANCIAL SUPERVISION COMMISSION (CSBF)
THE FIRST MINISTER, HEAD OF GOVERNMENT, Having regard to the Constitution, Having regard to Law No. 95-030 of February 1996 on the activity and supervision of credit institutions, as amended, Having regard to Decree No. 2007-022 of January 20, 2007 on the appointment of the First Minister, Head of Government, Having regard to Decree No. 2008-427 of April 30, 2008 on the appointment of members of the Government, Having regard to Decree No. 2007-185 of February 27, 2007 determining the powers of the Minister of Finance and Budget as well as the general organization of his Ministry, On the proposal of the Minister of Finance and Budget and the Governor of the Central Bank, In Council of Government, DECREES:
Article 1: Decree No. 2005-128 of March 8, 2005 on the appointment of members of the Banking and Financial Supervision Commission (CSBF) is hereby repealed.
Article 2: In application of Article 36 of Law No. 95-030 of February 22, 1996, in addition to the ex officio members, namely: • the Governor of the Central Bank, • the Director General of the Treasury, • the Director General of the Central Bank, • a Magistrate holding at least the rank of Counselor to the Supreme Court designated by the President of the Court, • a member designated by the Minister in charge of Finance, The following persons are appointed as members of the Banking and Financial Supervision Commission for a term of three (3) years: • Mrs. RALIJOHN Nirina Emma, • Mr. RALIJAONA Andry, • Mr. RAKOTOARIMANANA Victor.
Article 3: All prior provisions contrary to this Decree are and remain repealed.
Article 4: The Minister of Finance and Budget and the Governor of the Central Bank are each responsible, within their respective areas of competence, for the execution of this Decree, which shall be published in the Official Journal of the Republic.
