INSTRUCTION NO. 09/2023 of July 25 SUBJECT: FINANCIAL SYSTEM
Given the need to establish the rules for operation, access and information sharing of the Accounts Database (BDC), as established in Notice No. 08/2023 of July 17 regarding the Accounts Database. In accordance with the provisions of Article 148 of Law No. 14/21 of May 19, the General Regime for Financial Institutions Act, combined with paragraph f) of number 1 of Article 31 and number 1 of Article 98, both of Law No. 24/21 of October 18, the National Bank of Angola Act.
I DETERMINE:
Object and Scope 1.1 This Instruction establishes the rules and procedures regarding the operation and reporting of information in the Accounts Database, hereinafter referred to as "BDC". 1.2 This Instruction applies to the institutions provided for in Article 2 of Notice No. 08/2023 of July 17 regarding the Accounts Database.
Information to be Reported to the National Bank of Angola 2.1 Financial Institutions must report the information referred to in Annexes I, II, III, IV, V, VI and VII of this Instruction daily until 08:30 on the next business day. 2.2 Without prejudice to the preceding paragraph, Financial Institutions must report information regarding final balances as provided in Annex IV on Requirements for Reporting Banking Agents monthly until the 8th business day of the following month. 2.3 Banking Financial Institutions must provide the National Bank of Angola with information on bank and e-money accounts, banking agents, as well as customer information, defined in Annexes I, II, III, IV and V respectively under this Instruction, which are an integral part. 2.4 Non-banking Financial Institutions must provide the National Bank of Angola with information on e-money accounts and payment agents defined in Annexes II, III, VI and VII of this Instruction, which are an integral part. 2.5 Financial Institutions are responsible for providing correct, timely and reliable information to the BDC.
Rectifications 3.1 Whenever an Institution identifies an omission or incorrect communication of information, it must carry out the appropriate rectification, updating for this purpose the monthly information due to the BDC. 3.2 A Financial Institution that has sent incorrect information to the BDC must correct it immediately upon becoming aware of the inaccuracy, submitting or attaching the appropriate clarifications.
Responsible Persons of Institutions for Communication to BDC 4.1 Financial Institutions must appoint and indicate the staff responsible for interaction with the National Bank of Angola, regarding the provision of information under this Instruction, as well as ensure compliance with deadlines and quality of information subject to communication. 4.2 Any necessary changes made by the designated responsible persons must be communicated immediately to the National Bank of Angola.
Sanctions Non-compliance with the rules established in this Instruction constitutes an offence provided for and punishable under Law No. 14/21 of May 19, the General Regime for Financial Institutions Act.
Doubts and Omissions Doubts and omissions resulting from the interpretation and application of this Instruction are resolved by the National Bank of Angola.
Transitional Provision Institutions must comply with the provisions of this Instruction within 90 (ninety) days from the date of its publication.
