OJK Regulation No. 5 of 2025 on Supporting Professions in the Financial Services Sector

The Financial Services Authority (OJK) issued Regulation No. 5 of 2025 to mandate the registration of supporting professions operating within Indonesia's financial services sector. The regulation establishes specific requirements, documentation, and obligations for these professionals, including continuing education and reporting duties. It also repeals four previous OJK regulations concerning actuaries, public accountants, appraisers, legal consultants, and notaries to consolidate the regulatory framework.

Regulation of the Financial Services Authority Number 5 of 2025 concerning Supporting Professions in the Financial Services Sector

Abstract: In order to implement the registration obligation with the Financial Services Authority (OJK) for Supporting Professions carrying out activities in the Financial Services Sector as regulated in Article 259 of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector, and to further mandate the regulation of requirements and procedures for the registration of Supporting Professions in the Financial Sector, it is necessary to establish a Regulation of the Financial Services Authority concerning Supporting Professions in the Financial Services Sector.

The legal basis for this Regulation of the Financial Services Authority (POJK) is Law No. 21 of 2011 as amended by Law No. 4 of 2023; and Law No. 4 of 2023.

This Regulation of the Financial Services Authority regulates, among other things: a. The obligation to hold a license from the Ministry, Agency, and/or the supervising authority of the Supporting Profession, and the obligation to register with the Financial Services Authority, for Supporting Professions intending to carry out activities in the Financial Services Sector; b. Types of Supporting Professions required to be registered with the OJK; c. Activities/services required to use Supporting Professions registered with the OJK; d. Requirements and documents that must be fulfilled and submitted to the OJK in the context of the application for registration of Supporting Professions; e. Addition and/or reduction of the scope of services provided by Supporting Professions; f. Obligations and prohibitions of Supporting Professions, including obligations regarding Continuing Professional Education (PPL) and reporting; g. Provisions regarding the cessation of service provision when Supporting Professions are in a temporarily inactive or permanently inactive condition; h. Administrative sanctions for violations of obligations and prohibitions regulated in this Regulation of the Financial Services Authority; i. Media for submitting applications for registration, leave, resignation, and reporting; j. Provisions regarding the restriction of service provision by Supporting Professions; k. Transitional provisions.

Note: This Regulation of the Financial Services Authority applies to Supporting Professions carrying out activities in the Financial Services Sector.

This Regulation of the Financial Services Authority takes effect 1 (one) year from the date of promulgation.

This Regulation of the Financial Services Authority was promulgated on March 3, 2025, and established on February 26, 2025.

Requirements for professional credit units as a fulfillment of competence and knowledge for Supporting Professions, as well as provisions regarding PPL, will be determined by the Financial Services Authority.

Upon the entry into force of this Regulation of the Financial Services Authority: a. Regulation of the Financial Services Authority Number 38/POJK.05/2015 concerning the Registration and Supervision of Actuarial Consultants, Public Accountants, and Appraisers Conducting Activities in the Non-Bank Financial Industry; b. Regulation of the Financial Services Authority Number 66/POJK.04/2017 concerning Legal Consultants Conducting Activities in the Capital Market; c. Regulation of the Financial Services Authority Number 67/POJK.04/2017 concerning Notaries Conducting Activities in the Capital Market; and d. Regulation of the Financial Services Authority Number 68/POJK.04/2017 concerning Appraisers Conducting Activities in the Capital Market, are repealed and declared invalid.
