Regulations amending Finansinspektionen’s regulations regarding payment institutions and registered payment service providers

Finansinspektionen amended its regulations and general guidelines (FFFS 2010:3) concerning payment institutions and registered payment service providers. The changes specify that management assessment information must follow Chapter 6, section 5, and mandate the use of EU Regulation 575/2013 and FFFS 2014:12 for calculating capital requirements. These regulations entered into force on 2 August 2014.

Finansinspektionen prescribes pursuant to section 5, points 2 and 8 of the Payment Services Ordinance (2010:1008) that Chapter 3, section 11 and Chapter 9, section 1 of Finansinspektionen’s regulations and general guidelines (FFFS 2010:3) regarding payment institutions and registered payment service providers shall have the following wording. Chapter 3 Section 11 The information for management assessment with regard to the natural person and the person responsible for the payment service operations shall be appended as set out in Chapter 6, section 5. Chapter 9 Section 1 A payment institution shall apply the provisions in this chapter when calculating its capital requirement in accordance with Chapter 3, section 3 of the Payment Services Act (2010:751). After an application is submitted in accordance with Chapter 2, section 1, Finansinspektionen decides which method the firm shall use. Provisions for calculating own funds and their composition are provided in Articles 25–91 of Regulation (EU) No 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms and amending Regulation (EU) No 648/2012, and Chapter 3, section 1 and sections 3–11 of Finansinspektionen’s regulations (FFFS 2014:12) regarding prudential requirements and capital buffers.
