Instruction No. 41/2009R

The present instructions aim to specify the provisions of Instruction No. 41/2009R concerning the accounting and prudential reporting requirements for credit institutions and investment firms. They apply to establishments subject to the supervision of the Prudential Supervision and Resolution Authority (ACPR) or the Central Bank. The objective is to harmonize accounting practices and ensure consistent financial reporting across all supervised entities. They are applicable as of the date specified herein.

Article 1 The institutions covered by Article L. 511-7 of the Monetary and Financial Code are subject to the provisions of this instruction regarding general accounting, analytical accounting, and prudential rules. Establishments must also comply with the provisions relating to consolidated accounts and financial statements. In accordance with Article L. 612-1 of the Monetary and Financial Code, establishments must prepare summary statements that reflect their financial position accurately. These statements must be transmitted within the prescribed timeframe and follow a single accounting classification for all reporting categories.

Article 2 The provisions of this instruction apply to financial years closed as from January 1, 2010. Establishments must ensure that their annual accounts are prepared in compliance with the applicable accounting standards and prudential principles.

Article 3 The Prudential Supervision and Resolution Authority may grant derogations to institutions subject to this instruction, upon request and under defined conditions.

Article 4 This instruction enters into force on the date of its publication in the Official Bulletin. Establishments must align their reporting frameworks accordingly and submit all required documentation to the supervisory authority.
