Instruction No. 2020-I-07 of June 9, 2020 amending Instruction No. 2016-I-07 of March 11, 2016 regarding information to be transmitted to the ACPR on statutory auditors
The Autorité de Contrôle Prudentiel et de Résolution (ACPR) issued Instruction No. 2020-I-07 to amend the procedural requirements for transmitting information concerning statutory auditors. This amendment replaces Article 3 of the original 2016 instruction, mandating that such information be submitted via a dedicated entry form on the Banque de France's OneGate portal. The form must be electronically signed in accordance with existing ACPR instructions for the insurance and banking sectors, and the measure entered into force the day following its publication.
PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY
Instruction No. 2020-I-07 amending Instruction No. 2016-I-07 of March 11, 2016 regarding information to be transmitted to the Prudential Control and Resolution Authority on statutory auditors amended by Instructions No. 2018-I-03 of March 5, 2018 and No. 2018-I-04 of June 7, 2018
The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 612-2 and L. 612-24; Having regard to Instruction No. 2015-I-18 of October 2, 2015, as amended, regarding the electronic signature of documents transmitted electronically to the ACPR (Insurance Sector); Having regard to Instruction No. 2015-I-19 of October 2, 2015, as amended, regarding the electronic signature of documents transmitted electronically to the ACPR (Banking Sector); Having regard to Instruction No. 2016-I-07 of March 11, 2016, as amended, regarding information to be transmitted to the Prudential Control and Resolution Authority on statutory auditors; Having regard to the opinion of the Prudential Affairs Advisory Committee of May 7, 2020, DECIDES
Article 1: Article 3 of the aforementioned Instruction No. 2016-I-07 is replaced by the following provisions:
"Article 3: The information provided for in Article 2 of this Instruction is communicated to the ACPR via a dedicated entry form completed on the Banque de France's 'OneGate' portal, accessible at the following address: https://onegate.banque-france.fr. This form is electronically signed in accordance with Instructions No. 2015-I-18 (Insurance Sector) and No. 2015-I-19 (Banking Sector), as amended, regarding the electronic signature of documents transmitted electronically to the ACPR."
