ESMA Opinion on RTS specifying requirements for conflicts of interest for crypto-asset service providers under MiCA

The European Securities and Markets Authority issued this opinion to propose amendments to the European Commission's draft Regulatory Technical Standards regarding conflicts of interest for crypto-asset service providers under MiCA. ESMA recommends reinstating specific prohibitions on certain personal transactions, clarifying the scope of remuneration policies, and expanding resource requirements beyond human capital to ensure effective conflict management. Additionally, the Authority advocates for removing limitations on contractual arrangements triggering conflict checks and reinstating segregation measures for multifunction crypto-asset intermediaries to mitigate acute risks.
