ON MAKING AMENDMENTS AND SUPPLEMENTS TO RESOLUTION NO. 280-N OF THE BOARD OF THE CENTRAL BANK OF THE REPUBLIC OF ARMENIA DATED 7 OCTOBER 2014

For the purpose of defining the procedure for the registration of trust managers and persons performing management functions of other similar legal arrangements, Based on Point 7 of Part 1 of Article 11 of the Law "On Combating Money Laundering and Terrorism Financing", Guided by Part 3 of Article 2, Point "e" of Article 20 of the Law "On the Central Bank of the Republic of Armenia", and Articles 33 and 34 of the Law "On Normative Legal Acts", the Board of the Central Bank of the Republic of Armenia hereby:

R E S O L V E S:

1. In Resolution No. 280-N of the Board of the Central Bank of the Republic of Armenia dated 7 October 2014 "On Approving the Procedure for Registration of Reporting Entities defined by the Law of the Republic of Armenia 'On Combating Money Laundering and Terrorism Financing'" (hereinafter: Resolution), make the following amendments and supplement:

1. In the title of the Resolution, after the words "reporting entities", supplement with the words ", as well as the procedure for registration of trust managers and persons performing management functions of other similar legal arrangements";
2. In the preamble of the Resolution, after the words "reporting entities", supplement with the words ", as well as trust managers and persons performing management functions of other similar legal arrangements";
3. In the preamble of the Resolution, replace the words "Parts 5 and 6 of Article 9" with the words "Point 7 of Part 1 of Article 11";
4. In Point 1 of the Resolution, after the words "reporting entities", supplement with the words ", as well as trust managers and persons performing management functions of other similar legal arrangements".

2. In the "Procedure for Registration of Reporting Entities defined by the Law of the Republic of Armenia 'On Combating Money Laundering and Terrorism Financing'" approved by the Resolution (hereinafter: Procedure), make the following amendments and supplements:

1. In the title of the Procedure, after the words "reporting entities", supplement with the words ", as well as trust managers and persons performing management functions of other similar legal arrangements";
2. In Point 1 of the Procedure, after the words "(hereinafter: reporting entity)", supplement with the words ", as well as trust managers and persons performing management functions of other similar legal arrangements having a registration obligation on the basis of Part 2 of Article 9";
3. To recognize as void Point 2 of the Procedure;
4. To recognize as void Point 5 of the Procedure;
5. In Point 6 of the Procedure, remove the words "and shall be certified by the seal of the reporting entity (in case of existence of a seal)";
6. In Sub-point 3 of Point 7 of the Procedure, replace the words "the website of the Central Bank of the Republic of Armenia" with the words "email (fmc@fmc.am)";
7. Supplement the Procedure with Chapter 4 of the following content: "Chapter 4. Procedure for Registration of Trust Managers or Persons Performing Management Functions of Other Similar Legal Arrangements

14. The registration of a trust manager or a person performing management functions of another similar legal arrangement is carried out in accordance with the procedure established by Chapters 2 and 3 of this Procedure.
15. When submitting a registration application by a trust manager or a person performing management functions of another similar legal arrangement, "management of a trust or other similar legal arrangement" shall be filled in as the type of activity.";

8. In Annex 1 of the Procedure, replace the words "reporting entities defined by the Law of the Republic of Armenia 'On Combating Money Laundering and Terrorism Financing'" with the words "Reporting entities, as well as trust managers and persons performing management functions of other similar legal arrangements";
9. In the registration application form approved by Annex 1 of the Procedure, remove the word "Mr.";
10. In the registration application form approved by Annex 1 of the Procedure, replace the words "Reporting" with the word "Registered";
11. In the registration application form approved by Annex 1 of the Procedure, replace the words "Data of the internal observations body employee or the responsible employee" with the words "Data of the internal observations body employee of the reporting entity";
12. In the registration application form approved by Annex 1 of the Procedure, remove the words "L.S.";
13. In Annex 2 of the Procedure, replace the words "reporting entities defined by the Law of the Republic of Armenia 'On Combating Money Laundering and Terrorism Financing'" with the words "Reporting entities, as well as trust managers and persons performing management functions of other similar legal arrangements";
14. In Annex 2 of the Procedure, replace the words "Reporting" with the word "Registered";
15. From Annex 2 of the Procedure, remove the words "as a reporting entity,";
16. From Annex 2 of the Procedure, remove the word "L.S.". This Resolution shall enter into force on the day following its official publication.
