Instruction No. 2017-I-07 of July 19, 2017, on the Composition of Approval or Administrative Approval Transformation Files for Additional Professional Pension Funds, Institutions, or Mutuals

The Prudential Control and Resolution Authority (ACPR) issued this instruction to define the specific content requirements for administrative approval and transformation files for additional professional pension funds, institutions, and mutuals. It mandates that these dossiers, governed by the Insurance Code, Social Security Code, and Mutual Code, must be submitted electronically via the ACPR portal. The regulation entered into force on the day of its publication and has been subsequently amended by instructions in 2018, 2019, and 2024.

Instruction No. 2017-I-07 of July 19, 2017, regarding the composition of files for approval or administrative approval transformation for additional professional pension funds, additional professional pension institutions, or mutuals/unions for additional professional pensions, modified by Instruction No. 2018-I-14 of July 11, 2018, Instruction No. 2019-I-14 of April 18, 2019, and Instruction No. 2024-I-11 of October 21, 2024

The Prudential Control and Resolution Authority, Having regard to the Insurance Code, particularly Articles L. 382-1 and L. 382-2 and following, L. 384-1 and R. 382-1 and following; Having regard to the Monetary and Financial Code, particularly Articles L. 612-2 and L. 612-24; Having regard to the Mutual Code, particularly Articles L. 214-7, L. 214-8, and L. 214-9; Having regard to the Social Security Code, particularly Articles L. 941-11, L. 941-11-1, L. 942-7, and L. 942-9; Having regard to Ordinance No. 2017-484 of April 6, 2017; Having regard to the opinion of the Prudential Affairs Consultative Commission of June 1, 2017, DECIDES

Article 1 The file provided for in Article L. 382-2 of the Insurance Code, for the approvals mentioned in Article L. 382-1 of the Insurance Code ("additional professional pension funds"), in Article L. 942-7 of the Social Security Code ("additional professional pension institutions"), or in Article L. 214-7 of the Mutual Code ("mutuals and unions for additional professional pensions"), shall consist of the elements defined in the Annex.

Article 2 The file provided for in Article L. 382-2 of the Insurance Code, for the approval transformations mentioned in Paragraph II of Articles 4, 7, and 10 of Ordinance No. 2017-484 of April 6, 2017, shall consist of the elements defined in the Annex and the elements requested in the context of portfolio transfers referred to in Article L. 384-1 of the Insurance Code ("additional professional pension funds"), in Article L. 942-9 of the Social Security Code ("additional professional pension institutions"), or in Article L. 214-9 of the Mutual Code ("mutuals and unions for additional professional pensions").

Article 4 This instruction shall enter into force on the day of its publication.
