Consultation Paper No 1 of 2016 of ADGM Courts Fees

The Board of Directors of the Abu Dhabi Global Market issued this consultation paper to invite public comment on proposed fees for services provided by ADGM Courts. The Board determined these fees based on research of comparable jurisdictions to ensure the civil justice system remains accessible, fair, and efficient. Stakeholders are requested to submit written comments by May 9, 2016, before the Board finalizes the Schedule of ADGM Courts Fees.

CONSULTATION PAPER NO. 1 OF 2016 CONSULTATION PAPER NO. 1 OF 2016 – 18 APRIL 2016 ADGM COURTS FEES

2 INTRODUCTION

  1. The Board of Directors (the "Board") of Abu Dhabi Global Market ("ADGM") has issued this Consultation Paper to invite public comment on the Board's proposed fees for the services provided by ADGM Courts. A proposed Schedule of ADGM Courts Fees is Annexure A to this Paper. BACKGROUND
  2. On 17 December 2015 the Board enacted the ADGM Courts, Civil Evidence, Judgments, Enforcement and Judicial Appointments Regulations together with Rules dealing with a number of matters pertaining to ADGM Courts, including the jurisdiction of the Court of First Instance and certification of enforcement agents. At the same time, the Chief Justice enacted Rules dealing with matters of judicial conduct and judicial discipline.
  3. The Board is now seeking to determine the financial fees to be charged by ADGM Courts, which it is required to do under Abu Dhabi Law No. (4) of 2013.
  4. In order to assist the Board in developing proposals for such fees, ADGM Courts researched and analysed the fees charged by a number of comparable jurisdictions, including jurisdictions across the world. After careful consideration of that research and taking into account that the system of civil justice in ADGM Courts must be accessible, fair and efficient, the Board arrived at the fees set out in Annexure A to this Paper. COMMENTS HOW TO PROVIDE COMMENTS
  5. All comments should be in writing and sent to the address or email specified below. If you wish to send your comments by email, please state the Consultation Paper number in the subject line. You may ,if relevant, identify the organisation you represent in providing your comments. The Board reserves the right to publish, including on its website, any comments you provide, unless you expressly request otherwise at the time of making your comments. Comments supported by reasoning and evidence will be given more weight by the Board.
  6. The deadline for providing comments is Monday, 9 May 2016.
  7. Once we receive your comments, the Board will consider whether any modifications are required to the proposed fees. The Board will then proceed to determine the fees for ADGM Courts. You should not act on the proposals until the Schedule of Fees is published. A notice will be posted on our website informing you when this happens.
