International Obligations (Economic and Ancillary Measures) (United States of America) (Unilateral Sanctions) Directions 2019

The Bahamian Attorney-General issued the 2019 Unilateral Sanctions Directions to implement United States Executive Order 13382 concerning forty designated Iranian petrochemical entities. All regulatory agencies must instruct their licensees to search databases and beneficial owner registers for these designated persons or entities, then report the findings directly to the Attorney-General. The annex explicitly lists the forty targeted Iranian petrochemical companies and their operational addresses, ensuring domestic compliance with U.S. sanctions against weapons of mass destruction proliferation.

INTERNATIONAL OBLIGATIONS (ECONOMIC AND ANCILLARY MEASURES) (UNITED STATES OF AMERICA) (UNILATERAL SANCTIONS) DIRECTIONS, 2019

WHEREAS the Government of the United States of America (“U.S.”) has designated forty entities linked to Iran’s petrochemical sector, pursuant to Executive Order 13382 of July 1, 2005 – Blocking Property of Weapons of Mass Destruction Proliferators and Their Supporters (“U.S. Executive Order 13382”);

AND WHEREAS it has been determined that the designated entities listed in the Annex, have engaged or attempted to engage, in activities or transactions that have materially contributed to, or pose a risk of materially contributing to, the proliferation of weapons of mass destruction or their means of delivery, including any efforts to manufacture, acquire, possess, develop, transport, transfer or use such items, by any person or foreign country of proliferation concern;

AND WHEREAS the Government of the United States of America advises that individuals and entities that facilitate or conduct transactions on behalf of any of the designated entities or engages in significant trade with the designated entities, may be exposed to possible U.S. sanctions:

NOW THEREFORE in exercise of the powers conferred by section 3B (3)(a) of the International Obligations (Economic and Ancillary Measures) Act,¹ the Attorney-General gives the following directions —

  1. All regulatory agencies shall request their licensees to perform a search of their database and register of beneficial owners for any person [or entity] named in the U.S. Executive Order 13382.

  2. All regulatory agencies shall report the results of the search referred to under paragraph 1 to the Attorney-General.
