Instructions No. 13 of 2025 Regarding the Use of Cards in Point-of-Sale Services

The Palestine Monetary Authority issued Instructions No. 13 of 2025 to regulate fees and commissions charged on payment card transactions at point-of-sale terminals. The mandate requires service providers to refrain from imposing any fees or commissions on cardholders' accounts for such transactions and mandates that merchant agreements explicitly reflect this prohibition, with termination as a penalty for non-compliance. Applicable to all locally and internationally issued debit, credit, and prepaid cards, these Instructions take effect upon issuance and enforce penalties under Decision-Law No. 41 of 2022 for any violations.

Instructions No. (13) of 2025 Regarding the Use of Cards in Point-of-Sale Services

Based on the provisions of Decision-Law No. (41) of 2022 concerning National Payments, particularly Articles (7 and 18) thereof, and in light of what was approved by the Board of Directors of the Palestine Monetary Authority in its session No. (288) dated 08/10/2025, and in accordance with the powers delegated to us, and in pursuit of the public interest, we have issued the following Instructions:

Article (1) Objective and Scope of Application

  1. The provisions of these Instructions aim to regulate the fees and commissions for using payment cards via point-of-sale terminals.
  2. The provisions of these Instructions apply to all forms of payment cards, whether debit, credit, or prepaid, issued locally and outside Palestine.
  3. The provisions of these Instructions apply to point-of-sale service providers in Palestine.

Article (2) Point-of-Sale Services

The point-of-sale service provider must comply with the following:

  1. Not to charge any fees or commissions on the cardholder's account when using a payment card via its point-of-sale terminals.
  2. Including in the agreement signed with the merchant confirmation of the provision stated in paragraph (1) of this Article, and taking necessary measures to ensure merchant compliance, and terminating the agreement if the merchant violates its terms and conditions.

Article (3) Penalties

Any person who violates the provisions of these Instructions shall be penalized in accordance with Decision-Law No. (41) of 2022 concerning National Payments.

Article (4) Repeal of Conflicting Provisions

All provisions conflicting with these Instructions are repealed.

Article (5) Implementation and Enforcement

All competent authorities shall implement the provisions of these Instructions according to their respective jurisdictions, and they shall apply as of the date of issuance.
