The Superintendent of Banking, Insurance and Private Pension Fund Administrators CONSIDERING: That, pursuant to paragraph 9.3 of Article 9 of Legislative Decree No. 1611, which approves special measures for the prevention and investigation of extortion crimes and related offenses, as well as modifying the Penal Code (approved by Legislative Decree No. 635) and the Criminal Procedure Code (approved by Legislative Decree No. 957), within the framework of Peru's Public-Private Financial Information Exchange Mechanism (MEPIF), the respective authorities are responsible for deciding on the exchange of information regarding a case under investigation with obligated entities, which may only be used in investigating the facts that motivated it. All participating entities, their representatives, and personnel who have become aware of this information are subject to the confidentiality duty provided for in Article 12 of Law No. 27693, which creates Peru's Financial Intelligence Unit (UIF-Perú); That, SBS Resolution No. 03330-2024, which approves the Standard establishing guidelines regulating the operation of Peru's Public-Private Financial Information Exchange Mechanism (MEPIF), establishes that its objective is to facilitate the secure and effective exchange of strategic and operational knowledge and information, as applicable, between its public and private sector members, to strengthen the prevention, detection, investigation, and prosecution of extortion and related offenses, including money laundering, its precursor crimes, and terrorism financing, as well as to strengthen the fight against the financing of proliferation of weapons of mass destruction; That, according to subsection b) of Article 2 of the aforementioned standard, operational information that may be exchanged under MEPIF refers to data and other information regarding a case under investigation, by decision of the public authorities. The cited subsection specifies that public sector members of MEPIF decide the scope and timeliness of the information to be shared, as well as the method or means used for its exchange with private sector members; That, MEPIF's operation relies on its bodies and working groups, including the Cases Working Group, which is responsible for proposing and managing the implementation of the case selection protocol adopted by MEPIF's Executive Committee; therefore, pursuant to Article 2 of SBS Resolution No. 03330-2024, it is necessary to establish the validity of provisions regarding operational information exchange within MEPIF, which enables the formation and proper development of this working group's activities, with the aim of maximizing MEPIF's impact in combating extortion and related offenses, including money laundering, its precursor crimes, and terrorism financing, as well as strengthening the fight against financing for the proliferation of weapons of mass destruction; Having obtained approval from the Adjunct Superintendencies for Regulation and Legal Affairs, and from UIF-Perú; and, In exercise of the powers conferred by Law No. 29038 and Law No. 26702, in conjunction with Law No. 27693 and its modifying and implementing regulations; and, in accordance with the exception of the Thirty-Second Final and Transitional Provision of said Law No. 26702; RESOLVES:
Article First.– Establish the validity of subsection b) of Article 2, subsection b) of Article 3, and subsection c) of paragraph 6.2 of Article 6 of the Standard establishing guidelines regulating the operation of Peru's Public-Private Financial Information Exchange Mechanism (MEPIF), approved by SBS Resolution No. 03330-2024, regarding operational information, effective from the day following the publication of this resolution in the Official Gazette El Peruano.
Article Second.– The scope and timeliness of operational information that may be shared within MEPIF must not contravene the current legal framework and must be carried out within the competence of MEPIF's public sector members. Furthermore, the method and means used for such exchange must incorporate secure mechanisms that guarantee the safeguarding and confidentiality of operational information.
Article Third.– This resolution enters into force on the day following its publication in the Official Gazette El Peruano. Register, communicate, and publish.
