Implementation of ESMA guidelines on certain aspects of MiFID II suitability requirements (ESMA35-43-1163)

The Prudential Supervision and Resolution Authority (ACPR) College has declared conformity with the European Securities and Markets Authority (ESMA) guidelines regarding specific aspects of the MiFID II suitability requirements. These guidelines apply to credit institutions providing investment advice services concerning structured deposits as defined in Article L. 312-22 of the Monetary and Financial Code. Institutions are required to take all necessary measures to comply with these guidelines in accordance with Article 16 of Regulation (EU) No 1095/2010.

OPINION Implementation of the European Securities and Markets Authority (ESMA) guidelines concerning certain aspects related to the suitability requirements of the MiFID II directive (ESMA35-43-1163) The College of the Prudential Supervision and Resolution Authority (ACPR) has declared itself in conformity with the guidelines of the European Securities and Markets Authority (ESMA35-43-1163) concerning certain aspects related to the suitability requirements of the MiFID II directive. These guidelines apply to credit institutions that provide investment advice services regarding structured deposits as defined in Article L. 312-22 of the Monetary and Financial Code. These institutions shall take all measures to comply with these guidelines, in accordance with the provisions of Article 16 of Regulation (EU) No 1095/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Securities and Markets Authority).
