Resolution No. 1 of 2014 Approving Financial Investigation Agency Direction on Proliferation Financing

THE HOUSE OF ASSEMBLY OF THE VIRGIN ISLANDS RESOLUTION NO. 1 OF 2014 [Gazetted 8th May, 2014] WHEREAS Section 3 of the Proliferation Financing (Prohibition) Act, 2009 (No. 15 of 2009) (hereinafter referred to as “the Act”) provides that the Financial Investigation Agency (the Agency) may issue a direction in accordance with the provisions of Section 5(b) (iii) of the Act, where the Agency reasonably believes that there is a risk that terrorist financing, money laundering or proliferation activities are being carried on in a country and that this poses a significant risk to the interests of the Virgin Islands or the United Kingdom; WHEREAS the Agency has, in exercise of the power conferred by Section 3 of the Act, made the Direction Given By the Financial Investigation Agency Under Section 3 of the Proliferation Financing (Prohibition) Act, 2009, Statutory Instrument 2011 No. 74; AND WHEREAS an Order made pursuant to the said Section 3 of the Act shall be laid before the House for approval and, according to Section 11 of the Act, if, following the laying of the order, the House fails to approve the order within twenty-eight days from the date of laying, the order shall cease to have effect; NOW THEREFORE, BE IT RESOLVED by the House of Assembly of the Virgin Islands that the Direction Given By The Financial Investigation Agency Under Section 3 of the Proliferation Financing (Prohibition) Act, 2009, Statutory Instrument 2011 No. 74 be approved.
