Unofficial Consolidated Text (Narodne novine No. 152/24, 155/25) REGULATION ON THE STRUCTURE AND CONTENT OF FINANCIAL AND ADDITIONAL REPORTS OF PENSION INSURANCE COMPANIES
Introductory Provisions Article 1. This Regulation prescribes: – the structure and content of quarterly and annual financial reports of pension insurance companies, their submission methods and deadlines, and their publication; – the structure, content, submission method and deadlines for additional reports of pension insurance companies that such companies are obliged to prepare for the needs of the Croatian Financial Services Agency (hereinafter: Hanfa).
Maintenance of Accounting Books and Preparation of Financial Reports Article 2. (1) A pension insurance company is obliged to maintain accounting books, prepare accounting documents, value assets and liabilities, and prepare annual financial reports and financial reports for periods during the business year (hereinafter: financial reports) in accordance with the Act on Pension Insurance Companies (Narodne novine No. 22/14, 29/18, 115/18, 156/23 and 52/25, hereinafter: the Act), regulations governing accounting, and International Financial Reporting Standards (hereinafter: IFRS). (2) A pension insurance company is obliged to record business events in its accounting books using accounts at least within the scope of the prescribed chart of accounts.
REPORTS AND REPORTING Structure and Content of Financial Reports Article 3. (1) The financial reports of a pension insurance company consist of:
(2) The structure and content of the financial reports referred to in paragraph 1, items 1 to 4 of this Article are prescribed by the forms in Annex 1, which is an integral part of this Regulation. (3) The notes to the financial reports referred to in paragraph 1, item 5 of this Regulation are prepared in accordance with IFRS provisions so that they: – provide information on the basis of preparation and certain accounting policies applied in accordance with International Accounting Standard 1 (IAS 1), – disclose information required by IFRS that is not presented in the statement of financial position, statement of comprehensive income, statement of cash flows and statement of changes in equity, – provide additional information not presented in the statement of financial position, statement of comprehensive income, statement of cash flows and statement of changes in equity but which is important for understanding any of them.
Structure and Content of Additional Reports Article 4. (1) In addition to the financial reports under Article 3 of this Regulation, a pension insurance company is obliged to prepare additional reports to ensure further data and information on the financial position, business performance, and business activities of the company. (2) The additional reports of a pension insurance company are:
(3) The structure and content of the additional reports referred to in paragraph 2 of this Article are prescribed by the forms in Annex 2, which is an integral part of this Regulation.
Reporting Periods Article 5. (1) A pension insurance company is obliged to prepare: – financial reports under Article 3(1) for the business year period – annual financial reports, and for quarterly reporting periods during the business year (reporting date 31 March, 30 June, 30 September, 31 December) – quarterly financial reports; – additional reports under Article 4(2), items 1 to 5 and 8 to 18 for the business year period – annual additional reports; – additional reports under Article 4(2), items 1 to 5 and 8 to 13, plus items 17 and 18 for quarterly reporting periods during the business year (reporting date 31 March, 30 June, 30 September, 31 December) – quarterly additional reports; – additional reports under Article 4(2), items 6 and 7 for monthly reporting periods during the business year – monthly additional reports.
(2) Notes to the financial reports for quarterly reporting periods during the business year shall cover only significant business events and changes in accounting policies compared to the last published audited annual financial reports. (3) For the purposes of this Regulation, the business year is equal to the calendar year. (4) Annual financial reports under Article 3(1) must be audited by an external independent authorized auditor, and are prepared in accordance with the structure and content defined by the forms in Annex 1 of this Regulation.
Submission Deadlines for Reports Article 6. (1) A pension insurance company is obliged to submit quarterly financial reports under Article 3(1) and quarterly additional reports under Article 4(2) to Hanfa no later than one month after the reporting period has elapsed. (2) A pension insurance company is obliged to submit the monthly additional report under Article 4(2), item 6, to Hanfa no later than the tenth day of the month following the reporting month. (3) A pension insurance company is obliged to submit the monthly additional report under Article 4(2), item 7, to Hanfa no later than the end of the month following the reporting month. (4) A pension insurance company is obliged to submit audited annual financial reports under Article 3(1) and audited annual additional reports under Article 4(2) to Hanfa no later than four months after the end of the business year for which the reports are prepared.
Method of Report Submission Article 7. Reports under this Regulation must be submitted to Hanfa by the pension insurance company in accordance with Hanfa's technical instruction.
Publication of Financial Reports Article 8. (1) A pension insurance company is obliged to publish at least the following on its website: – semi-annual financial reports within deadlines identical to those in Article 6(1); – audited annual financial reports within deadlines identical to those in Article 6(4); – the auditor's opinion on the completed audit of annual financial reports within deadlines identical to those in Article 6(4); and – the opinion of an independent authorized actuary engaged by the audit firm within deadlines identical to those in Article 6(4).
(2) A pension insurance company is obliged to have its annual financial reports under paragraph 1 published on its website for at least the last five business years, or a shorter period if the company has operated for less than five years.
Transitional and Final Provisions Article 9. Reports as of 31 December 2024 are submitted in accordance with the provisions and annexes of the Regulation on the Structure and Content of Financial and Additional Reports of Pension Insurance Companies (Narodne novine No. 30/23), while reports for reporting periods from 1 January 2025 will be submitted in accordance with the provisions and annexes of this Regulation.
Article 10. Upon the entry into force of this Regulation, the Regulation on the Structure and Content of Financial and Additional Reports of Pension Insurance Companies (Narodne novine No. 30/23) ceases to apply.
Article 11. This Regulation will be published in Narodne novine and enters into force on 1 January 2025.
REGULATION ON AMENDMENTS AND SUPPLEMENTS TO THE REGULATION ON THE STRUCTURE AND CONTENT OF FINANCIAL AND ADDITIONAL REPORTS OF PENSION INSURANCE COMPANIES (Narodne novine No. 155/25)
Article 4. Form MOD-BKU (Statement on the Number of Pension Beneficiaries and Contracts) from Annex 2 is replaced by Form MOD-BKU (Statement on the Number of Pension Beneficiaries and Contracts), which constitutes Annex 1 of this Regulation.
Article 5. The structure and content of additional reports of pension insurance companies under Article 2 of this Regulation are prescribed by forms constituting Annex 2 of this Regulation, which is an integral part thereof.
Article 6. (1) The additional report of a pension insurance company under Article 4(2), item 6, of the Regulation on the Structure and Content of Financial and Additional Reports of Pension Insurance Companies (Narodne novine No. 152/24) – Statement on the Number of Pension Beneficiaries and Contracts (Form MOD-BKU), as of 31 December 2025, is submitted in accordance with the provisions of that Regulation. (2) Additional reports of pension insurance companies under Articles 4 and 5 of this Regulation, for reporting periods from 1 January 2026, will be submitted in accordance with the provisions of this Regulation.
Article 7. This Regulation will be published in Narodne novine and enters into force on 1 January 2026.
