Technical Instruction for the Preparation and Submission of Factoring Companies' Reports in Electronic Form

The Croatian Financial Services Supervisory Agency (HANFA) issued this Technical Instruction to mandate the electronic submission of annual and quarterly financial, additional, and capital calculation reports by factoring companies. The regulation specifies that reports must be submitted as digitally signed XML files using schemas published on the Agency's website, with signatures required from at least two management board members. The instruction entered into force on January 27, 2017, with the first applicable reporting periods being the quarterly reports as of March 31, 2017, and the annual reports as of December 31, 2017.

On the basis of Article 7, paragraph 1 of the Rules on Financial and Additional Reports and the Chart of Accounts for Factoring Companies ("Narodne novine" No. 41/16, 61/16) and Article 5, paragraph 5 of the Rules on the Capital of Factoring Companies ("Narodne novine" No. 12/15), the Croatian Financial Services Supervisory Agency, at a meeting of the Board of Directors held on January 27, 2017, adopts

TECHNICAL INSTRUCTION FOR THE PREPARATION AND SUBMISSION OF REPORTS OF FACTORING COMPANIES IN ELECTRONIC FORM

  1. Introduction A factoring company is obliged to submit annual and quarterly financial and additional reports of the factoring company to the Croatian Financial Services Supervisory Agency (hereinafter: the Agency) in accordance with the Rules on Financial and Additional Reports and the Chart of Accounts for Factoring Companies ("Narodne novine" No. 41/16, 61/16; hereinafter: the Rules) and the annual and quarterly report on the calculation of the capital of the factoring company in accordance with the Rules on the Capital of Factoring Companies ("Narodne novine" No. 12/15; hereinafter: the Capital Rules).

This Instruction regulates the format and method of submission of the aforementioned reports of factoring companies in electronic form.

  1. Types of Reports The types of reports submitted in electronic form are:
  • Financial and additional reports of factoring companies,
  • Report on the calculation of the capital of the factoring company.
  1. Submission of Reports Reports are submitted in electronic form in the following format and files:
  • an XML format file that covers the set of annual reports of factoring companies in accordance with the prescribed XML schema published on the Agency's website, signed with an advanced electronic signature by the Management of the company (G-FAKTORING). This file constitutes the set of annual financial and additional reports from the Rules and the annual report on the calculation of capital from the Capital Rules.

  • an XML format file that covers the set of quarterly reports of factoring companies in accordance with the prescribed XML schema published on the Agency's website, signed with an advanced electronic signature by the Management of the company (T-FAKTORING). This file constitutes the set of quarterly financial and additional reports from the Rules and the quarterly report on the calculation of capital from the Capital Rules.

  • an XML format file that covers the set of annual reports of factoring companies in liquidation in accordance with the prescribed XML schema published on the Agency's website, signed with an advanced electronic signature by the liquidator of the factoring company (G-FAKTORING-LIK). This file constitutes the set of annual financial and additional reports from the Rules, which factoring companies in liquidation are obliged to submit to the Agency on the basis of the Rules on the Application of Provisions of the Factoring Act and Other Regulations to Factoring Companies in Liquidation ("Narodne Novine" No. 52/15).

  • an XML format file that covers the set of quarterly reports of factoring companies in liquidation in accordance with the prescribed XML schema published on the Agency's website, signed with an advanced electronic signature by the liquidator of the factoring company (T-FAKTORING-LIK). This file constitutes the set of annual financial and additional reports from the Rules, which factoring companies in liquidation are obliged to submit to the Agency on the basis of the Rules on the Application of Provisions of the Factoring Act and Other Regulations to Factoring Companies in Liquidation ("Narodne Novine" No. 52/15).

  1. Description of the XML Format Report File Factoring companies are obliged to create report files in XML format in accordance with the prescribed XML schema of the Agency. XML schemas for the preparation of factoring company reports are available on the Agency's website (http://reports.hanfa.hr/Documentation). Factoring companies will independently determine the method by which they will enter data from the aforementioned forms into the XML report, and are responsible for its preparation in accordance with the prepared XML schema.

  2. Signing Files with an Advanced Electronic Signature Signing files with an advanced electronic signature, which the factoring company is obliged to submit, is carried out in accordance with the valid Technical Instruction on the Application of Electronic Signature in the Reporting Procedure of the Croatian Financial Services Supervisory Agency, published on the Agency's website. The rules for signing with an advanced electronic signature are the same as the rules that apply to the handwritten signature applied to the written form of the report. Factoring company reports are signed by at least two members of the factoring company's management board with an advanced electronic signature. Exceptionally, in case of inability, the management of the factoring company may, in accordance with regulations on representation, authorize another person in writing to sign reports with an advanced electronic signature, with prior notice to the Agency.

  3. Submission of Reports Reports from point 2 of this Technical Instruction are submitted by factoring companies in accordance with the valid Technical Instruction for Registration and Use of the Data Submission System Interface in Electronic Form, published on the Agency's website.

  4. Final Provisions This Technical Instruction enters into force on the day of its adoption, and is applied for the first time for quarterly reports from point 2 of this Technical Instruction which are prepared as of March 31, 2017, and submitted by April 30, 2017, and annual reports from point 2 of this Technical Instruction which are prepared as of December 31, 2017, and submitted by April 30, 2018.
