Circular SINAP 1-244 National Payments System - Electronic Compensation Chambers. Guarantees. Compliance.

The Central Bank of the Argentine Republic issued Communication A 8416 to revise guarantee calculations, non-compliance charges, and authorization requirements for financial entities operating through low-value electronic compensation chambers. The resolution mandates that all net debtor balances across the quarter determine guarantee calculations, introduces a first-annual-year exemption for non-compliance charges while applying subsequent charges to the full unpaid balance, and requires affiliated entities to authorize automatic debits from their current or foreign currency accounts when executed guarantees prove insufficient. Existing authorized institutions are exempt from the new calculation formula until granting this authorization, whereas new entrants must secure it to operate, and Communication A 8353’s penultimate paragraph is updated to specify real-time guarantee reporting and advance payments by Newpay SAU, Red Link SA, and COELSA.

We address you to inform you that this Institution has adopted the resolution which, in its pertinent part, provides: “1. Establish that, for the purposes of calculating the guarantees provided in the second paragraph of point 9.2.1.1. and in the first paragraph of point 9.2.2.1. of the consolidated text on the National Payments System – Electronic Compensation Chambers, the simple arithmetic average established therein will take into account all net debtor balances of the corresponding quarter. 2. Implement charges in case of non-compliance with the obligation to pay the debtor balances necessary to proceed with the settlements regulated in Section 9. of the consolidated text on the National Payments System – Electronic Compensation Chambers. The first non-compliance per calendar year will be exempt from any charge, and –for each subsequent non-compliance– a charge determined in accordance with the first paragraph of point 3.1.1. of the consolidated text on Minimum Cash (Section 3. Non-Compliance, point 3.1. Charge), which will be applied to the total unpaid debtor balance, shall apply. 3. Provide that every financial entity affiliated with a low-value electronic compensation chamber must authorize it to instruct the Central Bank of the Argentine Republic to make debits in its peso current account and in its foreign currency demand accounts corresponding to this Institution and with credit in that chamber, so as to settle the debtor balances arising from the settlement of payment instruments in which the financial entity operates, solely when, having defaulted on its payment, the available guarantees –once executed– are insufficient to cover the debtor balance. 4. Establish that financial entities authorized as of the date of publication of this communication, and until they grant the authorization established in point 3 above, will not be subject to the new calculation formula established in point 1 of this communication. For new financial entities, compliance with the authorization established in point 3 of this communication will be a condition for operation. 5. Repeal the last paragraph of point 9.2.1.2. of the consolidated text on the National Payments System – Electronic Compensation Chambers.

Replace, with effect for transactions formalized from 01/04/26, the penultimate paragraph of Communication A 8353 with the following: “c) At 8:00 a.m. (eight o'clock) on the following business day, Newpay SAU and Red Link SA administrators will inform the involved financial entities and COELSA, through the channel and mechanism determined by this Institution, the amount of the guarantee referred to in the previous point that was utilized to guarantee immediate transfers and ATM operations, so that through the MEP and before 11:00 a.m. (eleven o'clock) they make an advance payment of that amount.” We greet you respectfully.
