Unified Instructions for Funds Exempt from Seizure Under Court Orders

The Saudi Central Bank instructs all domestic banks and financial institutions to refrain from seizing funds received from specified government entities and transferred to executed-against parties under court orders. The directive mandates that these funds remain fully accessible for cash withdrawals and requires issuing banks to apply specific tariff codes in SWIFT fields 26T and 70 for accurate identification. In cases of erroneous deduction, banks must refund the amounts within 24 hours, thereby operationalizing established arrangements with the Ministry of Justice.

Subject: Unified Instructions for Funds Exempt from Seizure Under Court Orders.

Based on the powers of the Saudi Central Bank stipulated in the Banking Control System issued by Royal Decree No. (M/5) dated 1386/2/22 AH, and with reference to Article No. (21) of the Execution System issued by Royal Decree No. (M/53) dated 1433/8/13 AH, and to the arrangements concluded between the Saudi Central Bank and the Ministry of Justice regarding funds deposited in customers' bank accounts that are exempt from seizure under court orders, and following the Central Bank's instructions communicated to banks regarding funds exempt from seizure under court orders.

Based on the conclusions of the arrangements with the Ministry of Justice, the Central Bank confirms to all banks and financial institutions operating in the Kingdom that no funds received from the entities listed in the attached table and transferred to the bank accounts of the executed-against parties under court orders shall be seized, while emphasizing the availability of cash withdrawal for these funds as stated in the Central Bank's instructions communicated via Circular No. 52985/67 dated 1440/8/24 AH. In case of erroneous deduction, banks and financial institutions must refund the deducted funds within a maximum period of (24) hours. It is noted that issuing banks and financial institutions for transfers related to the entities in the attached table are responsible for ensuring these transfers are coded according to their specific tariff code ("Code").
