Instruction No. 2014-I-15 of 14 November 2014 amending Instruction No. 93-01 of the Banking Commission regarding the transmission of annual accounts, prudential documents and various information
The Prudential Control and Resolution Authority issued Instruction No. 2014-I-15 to amend Instruction No. 93-01 regarding the transmission of annual accounts and prudential documents. The amendment explicitly includes electronic money institutions and their specific derogations alongside payment institutions in the reporting obligations defined in Articles 2 and 3. These changes entered into force immediately upon publication on 14 November 2014.

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Article L. 526-1; Having regard to Instruction No. 93-01 of the Banking Commission of 29 January 1993 regarding the transmission of annual accounts, prudential documents as well as various information; Having regard to the opinion of the Prudential Affairs Consultative Commission dated 5 November 2014; Decides:
Article 1 In the first paragraph of Article 2, after the words "establishments subject to Article L. 451-1-2-I of the Monetary and Financial Code", the word "and" is replaced by ",".
After the words "payment institutions referred to in Article L. 522-1 of the Monetary and Financial Code", the words "and electronic money institutions referred to in Article L. 526-1 of the Monetary and Financial Code" are added.
In the third paragraph of this Article, after the words "Payment institutions using the derogation mentioned in the last paragraph of Article 5 of CRC Regulation No. 2009-08", the words "and electronic money institutions using the derogation mentioned in the last paragraph of Article 5 of ANC Regulation No. 2013-01" are added.
Article 2 In the first paragraph of Article 3, the expression "Subject establishments, financial companies and payment institutions" is replaced by the expression "Subject establishments, financial companies, payment institutions and electronic money institutions".

In the third paragraph of this Article, after the words "Payment institutions using the derogation mentioned in the last paragraph of Article 5 of CRC Regulation No. 2009-08", the words "and electronic money institutions using the derogation mentioned in the last paragraph of Article 5 of ANC Regulation No. 2013-01" are added.
Article 3 This Instruction shall enter into force upon its publication.
