Order of 11 Dhou El Kaada 1445 corresponding to 19 May 2024 fixing the rates and procedures for collection of fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations.

The Minister of Finance,
Having seen Legislative Decree No. 93-10 of 23 May 1993, as amended and supplemented, relating to the securities exchange, particularly its Article 27;
Having seen Presidential Decree No. 23-119 of 23 Chaâbane 1444 corresponding to 16 March 2023, as amended, appointing members of the Government;
Having seen Executive Decree No. 98-170 of 23 Moharram 1419 corresponding to 20 May 1998, as amended and supplemented, relating to the fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations, particularly its Article 3;
Having seen the Order of 9 Rabie Ethani 1419 corresponding to 2 August 1998 implementing Article 3 of Executive Decree No. 98-170 of 23 Moharram 1419 corresponding to 20 May 1998 relating to the fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations;
Orders:
Article 1. — In application of the provisions of Article 3 of Executive Decree No. 98-170 of 23 Moharram 1419 corresponding to 20 May 1998, as amended and supplemented, cited above, this Order aims to fix the rates and collection procedures for the fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations (COSOB).
Art. 2. — The rates of the fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations are fixed as follows:
— Application for visas for the issuance of securities or the offering of securities by public call for savings, the admission of securities to the stock exchange as well as for the public offer of sale, purchase, exchange or withdrawal of securities admitted to stock exchange trading:
• on the market for capital securities (main compartment), the market for debt securities (premium compartment), the professional investors market: the fee paid is fixed at 0.075% of the amount of the issuance or public offer. The amount of the fee must not exceed five (5) million dinars;
• on the market for capital securities (growth compartment), the market for debt securities (emerging compartment), the market for collective investment schemes (OPC): the fee is fixed at 0.05% of the amount of the issuance or public offer. The amount of the fee must not exceed one (1) million dinars.
— Application for approval of a stock exchange operations intermediary: fee of two hundred thousand (200,000) dinars;
— Application for approval of a participatory investment advisor: fee of one hundred thousand (100,000) dinars;
— Application for approval of a collective investment scheme: fee of one hundred thousand (100,000) dinars;
— Application for approval of a portfolio management company: fee of one hundred thousand (100,000) dinars;
— Application for registration of an authorized agent to conduct stock exchange negotiations: fee of one hundred thousand (100,000) dinars, paid by the stock exchange operations intermediary;
— Application for registration of a stock exchange promoter: fee of two hundred thousand (200,000) dinars;
— Application for registration of a valuer expert responsible for evaluating companies candidates for stock exchange listing: fee of two hundred thousand (200,000) dinars;
— Application for authorization of a securities custodian-account keeper: fee of two hundred thousand (200,000) dinars;
— Application for recognition of a financial rating: fee of two hundred thousand (200,000) dinars;
— Survey conducted among stock exchange operations intermediaries: fee equal to ten thousand (10,000) dinars per stock exchange operations intermediary;
— Resolution of technical disputes resulting from the interpretation of the legislative and regulatory texts governing the functioning of the stock exchange: fee of fifty thousand (50,000) dinars per case processed, paid by the applicant;
— Fee collected from the Stock Exchange Management Company (SGBV): annual fee fixed at 15% of the amount of commissions collected by the SGBV on the operations carried out on the stock exchange.
Art. 3. — The collection of fees collected under the conditions fixed above is carried out by the services of the Commission for the Organization and Supervision of Stock Exchange Operations.
Art. 4. — The provisions of the Order of 9 Rabie Ethani 1419 corresponding to 2 August 1998 implementing Article 3 of Executive Decree No. 98-170 of 23 Moharram 1419 corresponding to 20 May 1998 relating to the fees collected by the Commission for the Organization and Supervision of Stock Exchange Operations, are repealed.
Art. 5. — This Order shall be published in the Official Journal of the Algerian Democratic and Popular Republic.
