Order of 29 Dhou El Hidja 1429 corresponding to 27 December 2008 fixing the criteria of competence and professionalism for the management of investment capital companies. ———— The Minister of Finance, Having regard to Law No. 06-11 of 28 Joumada El Oula 1427 corresponding to 24 June 2006 relating to the investment capital company, particularly its Article 12; Having regard to Presidential Decree No. 08-366 of 17 Dhou El Kaada 1429 corresponding to 15 November 2008 appointing the members of the Government; Orders: Article 1. — In application of the provisions of Article 12 of Law No. 06-11 of 28 Joumada El Oula 1427 corresponding to 24 June 2006, cited above, this order aims to define the criteria of competence and professionalism that must be met by the management of the investment capital company. Art. 2. — The management of the investment capital company is considered to include the president and the members of the board of directors, the general manager, and the senior executives who have the power to make, on behalf of the company, commitments concerning disbursements of funds, taking of risks, or payment orders. Art. 3. — The president of the board of directors, the general manager, and the senior executives must hold a university degree and have a minimum professional experience of eight (8) years in one of the following fields: banking, finance, business economics, financial analysis, and risk management. Art. 4. — The members of the board of directors must hold a university degree and have a minimum professional experience of five (5) years in the economic, financial, commercial, or legal fields.
