Finding it necessary to exceptionally update the prudential ratios and limits applicable to credit institutions, in order to align them with the dynamics of the national economy, the Bank of Mozambique, using the competence conferred upon it by paragraph 1 of Article 85 of Law No. 20/2020, of December 31, the Credit Institutions and Financial Companies Law, determines:
ARTICLE 1 Subject Matter This Notice establishes the exceptional regime concerning the foreign exchange position limit provided for in the Regulation on Prudential Ratios and Limits of Credit Institutions, approved by Notice No. 9/GBM/2017, of June 5.
ARTICLE 2 Scope
ARTICLE 3 Foreign Exchange Position Limits For the purposes of the foreign exchange position limit referred to in Article 21 of the Regulation on Prudential Ratios and Limits of Credit Institutions, exceptionally, the credit institution must not present at the close of each day: a) a global long foreign exchange position exceeding 2% or a short position exceeding 20% of its own funds; and b) a foreign exchange position in each foreign currency that is long and exceeds 1% or short and exceeds 10% of its own funds.
ARTICLE 4 Duration of the Exceptional Regime The exceptional regime set forth in the preceding article shall remain in force for a period of three hundred and sixty-five days, counting from the date of entry into force of this Notice.
ARTICLE 5 Penalty Regime Non-compliance with the provisions of this Notice constitutes an administrative offence punishable under Law No. 20/2020, of December 31, the Credit Institutions and Financial Companies Law.
ARTICLE 6 Entry into Force This Notice shall enter into force on the date of its publication.
ARTICLE 7 Clarifications Doubts regarding the interpretation and application of this Notice must be submitted to the Prudential Supervision Department of the Bank of Mozambique.
