INSTRUCTION NO. 60 ON THE APPROVAL AND PUBLICATION OF THE TARIFF SCHEDULE FOR SERVICES PROVIDED BY CREDIT INFORMATION BUREAUS
The Central Bank of the Congo,
Having regard to Organic Law No. 18/027 of December 13, 2018, on the organization and functioning of the Central Bank, particularly Article 31;
Having regard to Law No. 23/059 of December 10, 2023, on the activity and supervision of Credit Information Bureaus, particularly Article 25;
Enacts the following provisions:
CHAPTER I: OBJECTIVE
Article 1:
This instruction sets forth the conditions for the approval and publication of the tariff schedule for information services provided by Credit Information Bureaus.
CHAPTER II: APPROVAL AND PUBLICATION PROCEDURE FOR THE TARIFF SCHEDULE OF CREDIT INFORMATION BUREAUS
Article 2:
Credit Information Bureaus are required to submit annually to the Central Bank of the Congo/Direction for the Supervision of Financial Intermediaries, by July 31 at the latest, their tariff proposals regarding services offered to clients for the following calendar year. These proposals must be accompanied by the projected financial statements of the Credit Information Bureaus for the relevant year.

Article 3:
Tariffs of Credit Information Bureaus must be differentiated by service categories and incorporate the principle of decreasing unit costs based on increasing consultation volumes.
In this regard, Credit Information Bureaus must take all necessary measures to establish a system capable of tracking client consultations. Tariffs are defined based on transparency and cost budgeting principles, enabling the Credit Information Bureau to cover all expenses justified by operational needs and ensure profitability.
Credit Information Bureaus must submit to the Central Bank of the Congo for approval, the tariff schedule for value-added services when applying for prior authorization to provide said services.
Article 4:
The Central Bank of the Congo has a period of ninety (90) days, from receipt of tariff schedule proposals containing the elements referred to in Article 2 above, to render a decision.
The Central Bank of the Congo may request any supplementary information it deems useful. The request for supplementary information suspends the period referred to in paragraph 1 above until the Credit Information Bureau transmits the supplementary information requested by the Regulatory and Supervisory Authority.
Article 5:
In case of refusal to approve the tariff schedule proposals submitted to the Central Bank of the Congo, the Credit Information Bureau must submit new proposals within fifteen days from the notification date, taking into account, where applicable, the remarks of the Regulatory and Supervisory Authority.
When the Central Bank of the Congo issues two successive decisions rejecting a tariff schedule approval, the applicable tariffs are those of the previously approved schedule reduced by 10%.
Article 6:
The approved tariff schedule is communicated by the Credit Information Bureau to credit information users, no later than (30) days before its entry into force.

Credit Information Bureaus must permanently display their approved tariff schedules in their premises as well as on their websites. They are required to publish this information in at least one widely circulated newspaper in the DRC, upon each tariff modification.
CHAPTER III: FINAL PROVISIONS
Article 7:
The Credit Information Bureau may, depending on the evolution of the technological, economic, and financial environment during the year, request approval for a new tariff schedule. This proposal for a new tariff schedule is processed in accordance with Articles 4 and 5 of this Instruction.
Article 8:
Failure by Credit Information Bureaus to comply with the provisions of this Instruction exposes violators to sanctions provided for by applicable legal and regulatory provisions.
Article 9:
This Instruction enters into force on the date of its signature and repeals all prior contrary provisions.
