The Autorité de Contrôle Prudentiel et de Résolution (ACPR) issued Instruction No. 2025-I-06 to update the regulatory framework for the electronic signature and transmission of regulatory reports by insurance entities. The instruction designates effective directors and their duly authorized delegates as the responsible parties for submissions made via the Banque de France's OneGate portal, establishing a 10-working-day period for contesting the validity of such transmissions. This directive replaces previous instructions from 2015 and 2017 and entered into force on July 1, 2025.

DECIDES
Article 1: This Instruction applies to insurance entities responsible for transmitting regulatory statements and collections to the ACPR.
Article 2: Unless otherwise indicated or specified in the relevant instructions, the persons authorized to make submissions are those ensuring the effective management of the insurance entity within the meaning of the first paragraph of II of Article L. 621-23-1 of the Monetary and Financial Code, the persons referred to in the second paragraph of II of the same article (hereinafter "the executives"), as well as any person duly authorized by the executives.
The aforementioned executives may also delegate authority to another group entity within the meaning of Article L. 356-1 of the Insurance Code if that entity is mentioned in Part B of I of Article L. 612-2 of the Monetary and Financial Code. In this case, the executives (effective, if applicable) of the delegate entity and the agents designated by them pursuant to the aforementioned provisions are authorized to make submissions.
The elements submitted in application of this Instruction are sent to the ACPR via the Banque de France's OneGate portal, under the responsibility of an executive referred to in the first paragraph who guarantees the quality and reliability of the information submitted. In the absence of a challenge within a period of 10 working days following the issuance of the processing report attesting to the submission of the statements by electronic transmission to the ACPR, the data will be treated as having been submitted on behalf of the entity by a duly authorized person.
Article 3: This Instruction replaces Instruction No. 2015-I-18 on the electronic signature of documents transmitted to the ACPR, modified by Instruction No. 2017-I-12 of June 26, 2017 (Insurance Sector).
It enters into force on July 1, 2025.
