Regulations Amending Finansinspektionen Mortgage Lending Rules FFFS 2023:17
Finansinspektionen has amended its mortgage lending regulations to require financial undertakings to submit specific documentation regarding owner and senior management assessments to the supervisory authority. These changes update Chapter 4, Sections 2 and 3 of FFFS 2016:29 to align with the newer ownership and management assessment rules established in FFFS 2023:12. The amended provisions will enter into force on 18 July 2023, ensuring standardized regulatory oversight of ownership structures and leadership in Swedish mortgage lending operations.

Finansinspektionen prescribes pursuant to section 12, points 1 and 14 of the Mortgage Business Ordinance (2016:1033) that Chapter 4, sections 2 and 3 of Finansinspektionen’s regulations (FFFS 2016:29) regarding mortgage business shall have the following wording. Chapter 4 Section 2 As part of the assessment of an undertaking’s owner, information and documents shall be submitted to Finansinspektionen in accordance with Finansinspektionen's regulations (FFFS 2023:12) regarding ownership, ownership management and management assessment in certain financial undertakings. Section 3 As part of the assessment of an undertaking’s management/senior management, information and documents shall be submitted to Finansinspektionen in accordance with Finansinspektionen's regulations (FFFS 2023:12) regarding ownership, ownership management and management assessment in certain financial undertakings.
