CySEC Introduces Form 165-05 for Prudential Consolidation Information

The Cyprus Securities and Exchange Commission issued Circular C644 to require Cyprus Investment Firms subject to prudential consolidation to submit Form 165-05. This new form collects data to support CySEC's supervisory role under EU Regulation 2019/2033 and related delegated regulations. Firms must submit the form annually via the Transaction Reporting System by May 31, with a specific deadline of June 30, 2024, for the 2023 reporting year.

TO : Cyprus Investment Firms (CIFs) FROM : Cyprus Securities and Exchange Commission DATE : 12 June 2024 CIRCULAR NO. : C644 SUBJECT : Introduction of CySEC’s Form 165-05 “Prudential Consolidation information” The Cyprus Securities and Exchange Commission (the “CySEC”) wishes herein to inform the Cyprus Investment Firms (‘the CIFs’) that are subject to prudential consolidation by CySEC about the following:

  1. Form 165-05 has been introduced by CySEC to collect information from entities within investment firm groups that are subject to prudential consolidation by CySEC. This initiative aims to facilitate CySEC’s supervisory role as consolidating supervisor pursuant to EU Regulation 2019/2033 ("IFR") and the Prudential Supervision of Investment Firms Law (Law 165(I)/2021).
  2. Form 165-05 is addressed to all CIFs falling under the definition of an investment firm group as outlined in Article 4(1)(25) of IFR and subject to prudential consolidation by CySEC under Articles 7 or 8 of the IFR.
  3. The data to be collected will facilitate CySEC in adhering to the requirements set in forth in Commission Delegated Regulation (EU) 2023/1118 supplementing Directive (EU) 2019/2034 with regard to regulatory technical standards specifying the conditions under which colleges of supervisors exercise their tasks.
  4. Form 165-05 is available under Section ‘Forms’ in CySEC’s website. CIFs are required to submit this form annually to CySEC via the Transaction Reporting System (‘TRS’) by the deadline of 31st May each year. Details regarding its submission are provided within the ‘Instructions’ sheet of Form 165-05. CySEC highlights that for the submission pertaining to the year ending 31.12.2023, CIFs are instructed to submit Form 165-05 via TRS by 30 June 2024, specifically between 25 with 30 June 2024.
