كافــة المصــدرة مــن شــركات مســاهمة أو مــن هيئــات اســتثمار جماعــي مشــترك، ب. ّأيــة شــهادات أو أدوات أخــرى مرتبطــة عوائدهــا أو فوائدهــا أو ّ أنصبــة أرباحهــا بــأداة مالي ّ ــة أو أدوات 1– ُي َحَّظ ُ ــر علــى كل شــخص مَّطِل ّ ــع علــى معلومــات مميــزة غيــر َن ّ ـة أن يتـداول، بصـورة مباشـرة أو غيـر مباشـرة، بـأداة ماليـة َ ُم ْعل ّ ّ قــة بــاألداة الماليــة المتداولــة المذكــورة. ّ متداولــة أو أي أداة ماليــة مرتبطــة بهــا إذا كان يملــك معلومــات َنــة متعل َ ّ ممي ُ ــزة غيــر م ْعل َنـة َ 2– ُي َحَّظ ُ ـر علـى كل شـخص مَّطِل ّ ـع علـى معلومـات ممي ُ ـزة غيـر م ْعل ّ أن يســتغل هــذه المعلومــات، الكتســاب أو للتنــازل أو لمحاولــة اكتســاب أو التنــازل، بصــورة مباشــرة أو غيــر مباشــرة، عــن أداة ّ ماليــة متداولــة تكــون هــذه المعلومــات مرتبطــة بهــا. 3– ّ يخضـع أي شـخص ) ُ غيـر الشـخص المَّطِل ّ ـع علـى معلومـات مميـزة َنـة( للحظـر المذكـور فـي البنديـن )1( و)2( أعـاه إذا كان َ ُ غيـر م ْعل ُ يعلـم أو يْفَت َـر ّ ض بـه أن يعلـم أن هـذه معلومات ممي ُ زة غير م ْعل أ. تزويـد أي شـخص ثالـث بهـذه المعلومـات خـارج إطـار الممارسـة االعتياديــة لعمــل هــؤالء األشــخاص، ب. تقديـم المشـورة أو النصـح لشـخص ثالـث بموضـوع التـداول بـأداة ّ ّ قــة بهــذه األدوات الماليــة أو ّ مالي ّ ــة متداولــة أو أي أداة مالي ّ ــة مرتبطــة بالمعلومــات المميــزة، أو لهــا عالقــة باكتســاب حقــوق متعل بالتنـازل عنهـا. 2– يشـمل الحظـر المشـار إليـه فـي ّ ـة متداولـة أن يضـع ويحـدث 1– ُ علـى الم ْص ِـدر ال ّذيــن يشــغلون مناصــب فــي الهيئــة قائمــة بأســماء األشــخاص ال ّ اإلداريـة واإلدارة العليـا التنفيذيـة، إضافـة إلـى أسـماء مفوضـي المراقبــة، 2– ُ علــى الم ْص ِ ــد ّ ر أن يــزو ّ د هيئــة األســواق الماليــة بنســخة مــن ّ القائمــة المذكــورة ونســخة مــن كل تحديــث، فــي مهلــة أقصاهــا عشــرة )10( ّ أيــام عمــل مــن تاريــخ حصــول أي تغييــر، 3– ّ علـى أي مـن األشـخاص المذكوريـن فـي البنـد )1 ( أعـاه أن يبلغوا أقصاهـا عشـرة )10( ّ أيـام عمـل مـن تاريـخ إجـراء العمليـة. ّ أو بـأداة مالي ّ ـة مرتبطـة بهـذه األداة الماليـة المتداولـة، فـي مهلـة ّ مباشـرة أو غيـر مباشـرة، علـى أداة مالي ُ ـة متداولـة لهـذا الم ْص ِ ـدر ّ هيئـة األسـواق المالي ّ ـة بجميـع العمليـات التـي قامـوا بهـا، بصـورة 4107 – فترات الحظر عن التداول
