Palestine Monetary Authority Instruction No. 4 of 2025 on the Use of Cards at Point of Sale

The Palestine Monetary Authority issued Instruction No. 4 of 2025 to regulate fees and commissions for card payments at point of sale terminals. The instruction mandates that point of service providers must not charge any fees or commissions to cardholders for using their cards and must enforce this prohibition through agreements with merchants. Violations of these provisions are subject to penalties under the National Payments Law No. 41 of 2022, and the instruction became effective upon its issuance.

Instruction No. (4) of 2025

Regarding the Use of Cards at Point of Sale Services

Based on the provisions of Law No. (41) of 2022 on National Payments, particularly Articles (7, 18) thereof, and following what was approved by the Board of Directors of the Palestine Monetary Authority in its meeting No. (288) dated 08/10/2025, and according to the powers delegated to us, and in pursuit of the public interest, we have issued the following Instructions:


Article (1)

Objective and Scope of Application

  1. The provisions of these Instructions aim to regulate fees and commissions for the use of payment cards at point of sale terminals.
  2. The provisions of these Instructions apply to all forms of locally issued and issued outside Palestine debit, credit, and prepaid payment cards.
  3. The provisions of these Instructions apply to point of sale service providers in Palestine.

Article (2)

Point of Sale

Point of sale service providers must comply with the following:

  1. Not to charge any fees or commissions to the cardholder's account when using a payment card at their point of sale terminals.
  2. To include in the agreement signed with the merchant a confirmation of the provisions mentioned in paragraph (1) of this Article, and to take the necessary measures to ensure the merchant's compliance therewith, and to terminate the agreement in case the merchant violates its terms and conditions.

Article (3)

Penalties

Anyone who violates the provisions of these Instructions shall be punished in accordance with the provisions of Law No. (41) of 2022 on National Payments.


Article (4)

Cancellation of Conflicts

All provisions conflicting with the provisions of these Instructions are hereby repealed.


Article (5)

Implementation and Enforcement

All competent authorities must implement the provisions of these Instructions, each within its respective jurisdiction, and apply them effective from the date of their issuance.
