ESMA Opinion on Supervisory Practices for Sustainability-Related Disclosures for Benchmarks

The European Securities and Markets Authority issued this opinion to address legal uncertainty arising from the application of new sustainability disclosure requirements for benchmarks without accompanying delegated acts. ESMA advises competent authorities to adopt consistent risk-based practices and not to prioritize supervisory or enforcement actions regarding specific ESG disclosure obligations until the necessary delegated acts are adopted. This guidance aims to ensure uniform application of Union law while the European Commission finalizes the technical standards required for compliance.
