The Prudential Control and Resolution Authority (ACPR) amends the framework for supervising housing loan risks by replacing the CREDITHAB reporting table and updating submission rules. The new requirements enter into force on 1 March 2020 for existing filers and 1 July 2021 for new filers, with transitional provisions allowing Excel submissions for early 2020 data. The instruction also specifies that central bodies must submit aggregated data for affiliated credit institutions and grants derogations for overseas departments and effort ratio breakdowns.
Instruction No. 2020-I-02 amending Instruction No. 2011-I-14 of 29 September 2011 on the supervision of risks on housing loans in France
The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 515-13 to L. 515-39 as well as L. 612-24 and R. 515-2 to R. 515-17; Having regard to Instruction No. 2011-I-14 of 29 September 2011 on the supervision of risks on housing loans in France, as amended by Instruction No. 2013-I-06 of 28 May 2013; Having regard to Recommendation No. CERS/2016/14 of the European Systemic Risk Board of 31 October 2016 aimed at filling gaps in real estate data, as amended by Recommendation No. CERS/2019/3; Having regard to the recommendation of the High Council for Financial Stability No. R-HCSF-2019-1 of 20 December 2019 on developments in the French residential real estate market in terms of credit granting; Having regard to the opinion of the Prudential Affairs Consultative Committee of 6 February 2020, DECIDES
Article 1: Instruction No. 2019-I-08 is repealed.
Article 2: The CREDITHAB table presented in the annex to Instruction No. 2011-I-14 is replaced by the table appearing in the annex to this Instruction.
Article 3: This Instruction enters into force:
2 As an exception to the rules for transmitting accounting and prudential information to the Prudential Control and Resolution Authority, data relating to the deadlines from January to September 2020 are submitted in Excel format to the address SATRISK-2777@acpr.banque-france.fr. During this period, subject institutions continue to electronically transmit the CREDITHAB statement as defined by Instruction No. 2011-I-14. As of the October 2020 deadline, to be submitted no later than 30 November 2020, institutions electronically transmit the CREDITHAB statement as defined by this Instruction, while also sending their first electronic submission the deadlines from January to September 2020. They therefore cease to electronically transmit the statement defined by Instruction No. 2011-I-14. By derogation from the rules mentioned in this paragraph:
Article 4: For networks of credit institutions with a central body, the submission of data, on an aggregated basis for all affiliated credit institutions, is carried out by the central body.
