Circular Letter (No. 189/2013)

The Central Bank of Libya issued Circular Letter No. 189/2013 to instruct commercial banks and their interim administrative committees to lift the suspension on foreign companies' local currency withdrawals and outbound financial transfers, effective upon compliance with existing CBL regulations. This directive follows the Libyan Interim Government's Cabinet decision to cancel People's General Committee Reference No. 2765, thereby restoring foreign firms' ability to transfer funds abroad without prior coordination with national contracting entities. Banks are required to process these transactions in accordance with CBL's established principles and to refer any specific outbound transfers ordered by foreign companies operating in Libya directly to the Central Bank for oversight.

This Administration has received the letter from Mr./Secretary General of the Council of Ministers of the Libyan Interim Government, Reference No. 11263 dated October 28, 2013, which referred to the Council of Ministers' review during its 31st and 32nd ordinary meetings for the year 2013 of the subject matter regarding the suspension of financial transfer procedures for foreign companies, as stipulated in the letter from the Secretary General of the People's General Committee (formerly) No. (2765) dated May 26, 2011. It further informed, via its letter, that the Council of Ministers decided to cancel Reference No. (2765) and lift the suspension on financial transfers abroad, such that they shall be in accordance with the principles and regulations enforced by the Central Bank of Libya.

And with reference to our Circular Letter No. AMN (2011/97) dated June 22, 2011, which forwarded the letter from Mr./Secretary General of the People's General Committee, Reference No. 2765 dated May 26, 2011, which requested the suspension of foreign companies' transfers abroad or the use of their accounts for local withdrawal purposes, except with prior coordination with national entities contracted with them.

And as we enclose for you a copy of the letter from Mr./Secretary General of the Council of Ministers of the Libyan Interim Government dated October 28, 2013, referenced above, it is requested that you take the necessary measures regarding lifting the suspension on withdrawing any local currency amounts belonging to foreign companies, in the absence of other legal impediments, with the necessity of referring to the Central Bank of Libya regarding any financial transfers abroad ordered by foreign companies operating in Libya.

We inform you that the Council of Ministers decided to cancel the aforementioned letter and lift the suspension on financial transfers abroad, such that they shall be in accordance with the principles and regulations enforced by the Central Bank of Libya.
