The Prudential Control and Resolution Authority issued Instruction No. 2018-I-02 to update the regulatory framework for electronic money institutions. The instruction replaces the standard application forms for authorization, simplified authorization, and exemption from authorization with new standardized templates. These changes align the documentation requirements with the prudential regulation established by the May 2, 2013 decree.
Instruction No. 2018-I-02 amending the application forms for authorization, simplified authorization and exemption from authorization for electronic money institutions
The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, Having regard to the Decree of May 2, 2013 concerning the prudential regulation of electronic money institutions, Having regard to Instructions No. 2013-I-09 and No. 2013-I-13 of the Prudential Control Authority, Having regard to the opinion of the Consultative Committee on Prudential Affairs dated February 14, 2018, DECIDES:
Article 1: The standard file for the application for authorization as an electronic money institution, referred to in Article 2 of the aforementioned Decree and in the annex to Instruction No. 2013-I-09, is deleted and replaced by the standard file in Annex 1 to this Instruction.
Article 2: The standard file for the application for authorization as an electronic money institution with derogatory prudential status, presented in the annex to Instruction No. 2013-I-09, is deleted and replaced by the standard file for obtaining simplified authorization as an electronic money institution referred to in Article 2-1 of the aforementioned Decree. This file is attached to Annex 2 to this Instruction.
Article 3: The standard file for the application for exemption from authorization as an electronic money institution, referred to in Instruction No. 2013-I-13, is deleted and replaced by the standard file for declaration in Annex 3 to this Instruction.
