The Commission d’Organisation et de Surveillance des Opérations de Bourse (COSOB) issued this instruction to define the procedures for registering brokers and issuing professional cards. It mandates that applicants submit specific personal and educational documents, pass a professional aptitude exam focused on the quotation system, or qualify for an exemption through recognized training. Upon registration in the stock exchange management company's registry, holders are authorized to exercise the function of broker on the exchange floor.
Instruction COSOB No. 99-03 of June 16, 1999 Regarding the Issuance of the Professional Card.
Article 1. — This instruction aims to establish the procedures for the registration of the broker and the issuance of the professional card provided for by COSOB Regulation No. 97-02 of November 18, 1997.
Art. 2. — The application for broker registration is addressed to the Commission d’Organisation et de Surveillance des Opérations de Bourse, hereinafter referred to as the Commission, using the form attached to this instruction.
Art. 3. — The completed registration form must be signed by the manager of the Securities Market Intermediary on whose behalf the broker operates. It must be accompanied by the candidate's file, composed of the following documents: — One (01) extract of the birth certificate, — One (01) extract of the criminal record (No. 03), — Certified true copies of the required diplomas, — Certified true copies of certificates and attestations of training in the field of securities, — Four (04) recent passport-sized photographs.
Art. 4. — The issuance of the professional card is subject to a favorable result from a professional aptitude examination, unless a derogation is provided for by this instruction.
Art. 5. — The organization of the professional aptitude examination is entrusted to a committee designated by the President of the Commission. The examination focuses essentially on the quotation system.
Art. 6. — The committee rules on the candidate's aptitudes and submits the examination results to the Commission.
Art. 7. — The professional card is issued by right to the manager assuming the general direction of the Securities Market Intermediary who meets the qualification conditions set forth in Article 5 of COSOB Regulation No. 96-03 of July 3, 1996.
Art. 8. — Any person, acting on behalf of a Securities Market Intermediary and having successfully undergone training in the field of securities trading and management recognized by the Commission, is exempt from the examination provided for in Article 4 above.
Art. 9. — The registration of professional card holders on the register maintained by the Stock Exchange Management Company entails the authorization to exercise the function of broker on the exchange floor.
Art. 10. — In the event of loss or theft of the professional card, the concerned Securities Market Intermediary must immediately inform the Commission.
Art. 11. — This instruction takes effect on the date of its signature.
