The Prudential Control and Resolution Authority (ACPR) issued Instruction No. 2021-I-04 to amend the annual prudential reporting requirements for entities supervised under the Solvency II regime. This instruction replaces Annex A of Instruction No. 2016-I-16 to align with recent legislative updates, including Decrees No. 2019-1437 and No. 2021-760 concerning diversification provisions and the classification of insurance and pension commitments. The amended reporting obligations apply to collections due for financial years ending on or after December 31, 2021.

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 612-2 and L. 612-24; Having regard to Decree No. 2019-1437 of December 23, 2019, relating to insurance or capitalization contracts involving commitments giving rise to the establishment of a diversification provision and adapting the operation of various insurance products; Having regard to Decree No. 2021-760 of June 14, 2021, relating to the classification of insurance, capitalization, and supplementary professional pension commitments; Having regard to the Order of June 14, 2021, relating to the classification of insurance, capitalization, and supplementary professional pension commitments; Having regard to Instruction No. 2016-I-16 of June 27, 2016, regarding annual prudential documents to be communicated by entities subject to ACPR supervision under the so-called "Solvency II" regime; Having regard to the opinion of the Prudential Affairs Advisory Commission of February 25, 2021,
DECIDES
Article 1: Annex A of Instruction No. 2016-I-16 is replaced by Annex A of this Instruction.
Article 2: This Instruction applies with respect to collections due for financial years ending on or after December 31, 2021.
