FSCA Draft Conduct Standard on Requirements for Managers of Collective Investment Schemes

The Financial Sector Conduct Authority submitted a draft Conduct Standard to Parliament on 8 May 2025 to establish updated regulatory requirements for managers of collective investment schemes. This framework replaces outdated rules and aligns managerial obligations with broader financial sector laws to strengthen consumer protection outcomes. Supporting documentation, including a consultation report and submission notice, is publicly accessible on the FSCA website for stakeholder review.

FSCA COMMUNICATION 11 OF 2025 (CIS) Submission to Parliament of draft Conduct Standard – Requirements for Managers of Collective Investment Schemes

  1. The purpose of this Communication is to inform stakeholders that on 8 May 2025, the following draft Conduct Standard and supporting documents were submitted to Parliament in terms of section 103(1) of the Financial Sector Regulation Act, 2017 (Act No. 9 of 2017): 1.1 Conduct Standard – Requirements for Managers of Collective Investment Schemes (draft Conduct Standard); 1.2 Statement supporting the draft Conduct Standard; 1.3 Consultation Report on the draft Conduct Standard; and 1.4 Notice inviting submissions on the draft Conduct Standard.
  2. The draft Conduct Standard prescribes requirements for managers of collective investment schemes. The purpose of the draft Conduct Standard is to update and enhance the current, outdated regulatory framework applicable to managers of collective investment schemes. Further the draft Conduct Standard ensures that the framework supports the delivery of outcomes that are consistent with the outcomes set out in other financial sector laws supervised by the FSCA, especially relating to consumer protection.
