Instruction No. 2018-I-01 of February 21, 2018, amending payment institution approval and exemption forms and creating simplified approval and account information service provider registration forms

The Prudential Control and Resolution Authority issued Instruction No. 2018-I-01 to update and replace the standard application dossiers for payment institution approvals, exemptions, and agent declarations. The instruction introduces new standardized forms for simplified payment institution approvals and registration as account information service providers. These changes align regulatory documentation with the Monetary and Financial Code and previous ACPR instructions.

PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY

Instruction No. 2018-I-01 amending the approval and exemption from approval forms for payment institutions, exemption from approval under the conditions set out in Articles L. 521-3-1 and L. 525-6-1 of the Monetary and Financial Code, agent declaration and creating the simplified approval forms for payment institutions and registration as account information service providers

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, Having regard to the Order of October 29, 2009, concerning the prudential regulation of payment institutions, Having regard to Instructions No. 2011-I-17, No. 2013-I-09 and No. 2013-I-13 of the Prudential Control Authority, Having regard to the opinion of the Prudential Affairs Consultative Commission of February 14, 2018, DECIDES:

Article 1: The standard file for the application for approval as a payment institution, referred to in Article 2 of the aforementioned Order and in the annex of Instruction No. 2011-I-17, is repealed and replaced by the standard file in Annex 1 of this Instruction.

Article 2: The standard file for the application for simplified approval as a payment institution, referred to in Article 2-1 of the aforementioned Order, is attached to Annex 2 of this Instruction.

Article 3: The standard file for the application for registration as a provider of account information services, referred to in Article 2-2 of the aforementioned Order, is attached to Annex 3 of this Instruction.

Article 4: The standard file for the agent declaration of a payment service provider, referred to in I of Article 36 of the aforementioned Order and in the annex of Instruction No. 2013-I-09, is repealed and replaced by the file in Annex 4 of this Instruction.

Article 5: The standard file for the application for exemption from approval as a payment institution, under the conditions set out in Article L. 521-3 of the Monetary and Financial Code, referred to in Instruction No. 2013-I-13, is repealed and replaced by the standard declaration file in Annex 5 of this Instruction.

Article 6: The declaration of exemption from approval as a payment institution and/or exemption from approval as an electronic money institution, under the conditions set out in Articles L. 521-3-1 and L. 525-6-1 of the Monetary and Financial Code, must be accompanied by the standard file attached to Annex 6 of this Instruction.
