ABSTRACT: In order to follow up on the mandate of Financial Services Authority Regulation Number 61/POJK.07/2020 concerning Alternative Dispute Resolution Institutions in the Financial Services Sector (State Gazette of the Republic of Indonesia Year 2020 Number 290 and Supplement to the State Gazette of the Republic of Indonesia Number 6599), it is necessary to further regulate provisions regarding the procedures for competence and propriety interviews for Candidates for Supervisory Bodies and Candidates for Management of Alternative Dispute Resolution Institutions in the Financial Services Sector in an Otoritas Jasa Keuangan (OJK) Circular Letter (SEOJK).
The legal basis for this SEOJK is: Law Number 21 of 2011 concerning the Financial Services Authority (State Gazette of the Republic of Indonesia Year 2011 Number 111 and Supplement to the State Gazette of the Republic of Indonesia Number 5253).
This SEOJK regulates Parties Participating in Interviews on Competence and Propriety, Assessment Factors in Interviews on Competence and Propriety, Administrative Requirements for Candidates for Management and/or Supervisory Bodies of Alternative Dispute Resolution Institutions in the Financial Services Sector, Procedures for Fulfilling Administrative Document Requirements, Procedures for Requests for Approval of Candidates for Management and/or Supervisory Bodies of Alternative Dispute Resolution Institutions in the Financial Services Sector, Mechanisms for Interviews on Competence and Propriety, Results of Interviews on Competence and Propriety, and Transitional Provisions in Interviews on Competence and Propriety for candidates for Management and/or Supervisory Bodies who are currently undergoing the process.
Notes: Resumes, self-assessments regarding the fulfillment of integrity, financial reputation, and competency requirements for candidates for Management and/or Supervisory Bodies refer to Appendix I, which is an integral part of this SEOJK. Completeness of administrative document requirements for candidates for Management and/or Supervisory Bodies refers to Appendix II, which is an integral part of this SEOJK. The submission of request letters for approval of candidates for Management and/or Supervisory Bodies submitted by Alternative Dispute Resolution Institutions in the Financial Services Sector to the Financial Services Authority refers to Appendix III, which is an integral part of this SEOJK.
This SEOJK takes effect on the date of establishment, namely September 20, 2023.
