Circular No. 146: Loans for Members of the National Security Forces

With reference to the above subject, please find attached for your information the instructions issued by the National Security Forces Command to its members regarding borrowing from banks operating in Palestine. Please take the necessary legal action accordingly.

Instructions No. (01) Issued on: 2012/07/01 Regarding Borrowing from the Palestinian Banking Sector

Based on the provisions of Article (7) of the Internal Regulations of the Palestinian Security Forces Service Law No. (8) of 2005, and in light of public interest and operational requirements, the following instructions govern borrowing from the Palestinian banking sector:

  1. The member must have completed at least two years of active service.
  2. The member's total debt obligations (loans), regardless of the loan type (including guarantees for colleagues or others + automatic payment bills), must not exceed 50%, and his guarantees for others must not exceed a single individual only.
  3. The member must obtain prior written approval from the Financial Administration/National Security Forces addressed to the relevant bank.
  4. The borrowing member must provide the relevant bank with a salary voucher for the previous month, certified by the Military Financial Administration/National Security Forces - Payroll Department.

Having reviewed the provisions of the amended Basic Law of 2003 and its amendments, and the Security Forces Service Law No. (8) of 2005, and based on the powers vested in us, and in pursuit of the public interest, we have decided as follows:

Article (1) Brigadier General / Nidal Ali Mahmoud Abu Duhan is promoted to the rank of Major General and appointed as Commander of the Palestinian National Security Forces.

Article (2) All provisions conflicting with this Decision are hereby repealed.

Article (3) All relevant authorities shall, each within their respective competence, implement the provisions of this Decision. It shall take effect from the date of its issuance and be published in the Official Gazette.

Article (7) The Minister of National Security, jointly with the Commander-in-Chief of National Security, holds the authority to issue the necessary regulatory, administrative, and financial decisions to manage the operations of the National Security Authority and organize its internal affairs, including human resources, armament, logistics, and mission preparation, in a manner consistent with the provisions of the (Palestinian Security Forces Service Law No. 8 of 2005) and the regulations governing the planning of this law within the executive bylaws.

Article (8)

  1. The Supreme Commander of the Palestinian Security Forces, in his capacity as President of the Palestinian National Authority, shall appoint the Commander-in-Chief of the National Security Forces and the Commander of the Palestinian National Liberation Army in accordance with public interest, without being bound by absolute seniority or years of service compared to his officer counterparts.
  2. The appointment term for the Commander-in-Chief shall be three years, renewable by the Supreme Commander for a single additional year only.

Article (9)

  1. The Minister of National Security, jointly with the Commander-in-Chief and with the approval of the Officers Committee, holds the authority to appoint heads of bodies, directors of departments, regional commanders, and military attachés at Palestinian embassies abroad.
  2. The Minister shall issue individual appointment decisions for each officer in accordance with public interest, without being bound by absolute seniority or years of service compared to his officer counterparts.

Article (10) The Minister of Interior, jointly with the Director General of Internal Security, who is in turn responsible for (Police/Preventive Security/Civil Defense), holds the authority to issue regulatory, administrative, and financial decisions
