The Prudential Control and Resolution Authority (ACPR) Supervisory College established the Prudential Affairs Advisory Commission to issue opinions on draft instructions regarding periodic reporting and authorization dossiers for the insurance and banking sectors. The Commission's composition includes ACPR College members, designated representatives from professional associations and supervised entities, and the Caisse des Dépôts et Consignations, with proceedings managed by the ACPR General Secretariat. This decision, which replaces the 2024-C-10 decision, formalizes the consultation procedures and membership structure for these prudential regulatory matters.
Decision No. 2025-C-09 17 March 2025 Establishment of an Advisory Commission THE COLLEGE IN PLENARY SESSION Having regard to the Monetary and Financial Code, particularly Article L. 612-14-I; Having regard to the deliberations of the College of 17 March 2025, DECIDES
Article 1 A consultative commission, the Prudential Affairs Advisory Commission, is hereby established, charged with issuing an opinion, prior to their adoption, on the instructions of the Authority that determine:
the lists, templates, frequency, and deadlines for the transmission of documents and periodic information that must be submitted to the Prudential Control and Resolution Authority in application of the first paragraph of Article L. 612-24 of the aforementioned Code, with the exception of those falling within the field of combating money laundering and terrorist financing (AML-CFT), which, due to their specificity, are subject to consultation by a distinct specialized commission;
standard files for applications for approval or authorization of any kind, including in particular the list, format, and methods of transmission of information necessary for the Authority to rule, in application of Article R. 612-21 of the aforementioned Code, with the exception of those concerning cash changers, which are subject to consultation by a distinct specialized commission.
The commission is also consulted, for opinion, on draft notices or explanatory guides intended for professions subject to the Authority's control, containing an analysis of prudential regulations or describing the Authority's procedures regarding approval or control, outside the AML-CFT domain, prior to their adoption or when the update involves a substantial change to existing documents.
The commission is seized by the President of the Authority.
Article 2: I - The presidency of the advisory commission is exercised by a member of the Supervisory College designated by the Supervisory College, upon proposal by the President of the Authority. One or two Vice-Presidents possessing complementary experience to that of the President are also designated by the Supervisory College according to the same procedures. The names of the College members thus designated are listed in Annex 1.
II - The following are also members of the commission:
Natural persons, designated within persons subject to ACPR control, whose names appear on the list in Annex 2 to this Decision for the insurance sector and in Annex 3 for the banking sector.
The Caisse des Dépôts et Consignations. It designates a natural person to represent it.
Article 3: The President establishes, for each meeting of the commission, its agenda and the list of members to be summoned, after soliciting the opinion of the Vice-President(s).
The President may invite qualified personalities to participate in the commission's work, if deemed useful, particularly auditors operating in the insurance or banking sectors.
The Director General of the Treasury or their representative is invited to the commission's meetings.
The President of the Sanctions Commission may designate a member who attends the commission's work.
When the documents submitted for consultation concern only one of the two aforementioned sectors, the President may decide to summon only the members of the concerned sector. The Caisse des Dépôts et Consignations is summoned with the members of the banking sector. All members are nevertheless informed of the subjects submitted by the Authority for consultation.
When the commission is consulted on a draft document that specifically concerns a category of persons subject to regulation that is not represented as such by the members of the commission, the President invites one or more qualified personalities among the directly concerned persons to participate in the commission's work.
The General Secretariat of the ACPR (SGACPR) ensures the secretariat of the commission. The secretariat prepares a synthetic summary of the debates at the end of each meeting, accompanied by a record of conclusions, if applicable, which is communicated to the members for approval at the next meeting.
Article 4: The President establishes the consultation schedule, which is presented at the first meeting for each consultation. The schedule takes into account both the Authority's constraints and the time necessary for the commission members, if applicable, to review the subject of the consultation and provide a relevant opinion, taking into account the impact of the project on persons subject to the Authority's control.
Article 5: At the end of the consultation, the commission adopts an opinion which is communicated to the Supervisory College. Only the members of the commission have deliberative votes. The opinion is signed by the President.
Article 6: This Decision repeals and replaces Decision No. 2024-C-10 of 4 March 2024 of the Supervisory College of the Prudential Control and Resolution Authority regarding the establishment of an advisory commission, as amended.
Article 7: This Decision will be published in the Official Register of the Prudential Control and Resolution Authority.
