Zambia Institute of Architects (Constituted under the Zambia Institute of Architects Act No. 36 of 1995, CAP 442)

The Architects (Site Identification) Regulations, 2025

WHEREAS the Zambia Institute of Architects (ZIA) is the professional body established under the Zambia Institute of Architects Act No. 36 of 1995, Chapter 442 of the Laws of Zambia, tasked with regulating the architectural profession and upholding standards in the built environment;

AND WHEREAS it is imperative for public safety, consumer protection, and professional accountability that all stakeholders in a construction project are readily identifiable at the project site;

AND WHEREAS there is a need to curb illicit construction activities and protect the interests of clients, consultants, and the public by ensuring transparency;

NOW, THEREFORE, in exercise of the powers conferred upon the Zambia Institute of Architects by Section 4 of the Architects Act, CAP 442, the following Regulations are hereby made:

  1. Title These Regulations may be cited as the Architects Site Identification and Stakeholder Disclosure Regulations, 2025.

  2. Interpretation In these Regulations, unless the context otherwise requires— "Act" means the Zambia Institute of Architects Act, CAP 442; "Construction Site" means any piece of land or premises upon which building, alterations, interior design, engineering, or landscape construction work is being undertaken; "Lead Consultant" means the Registered Architect appointed as the principal consultant for the project, responsible for the coordination of all design disciplines; "Developer" means the person or entity for whom the project is being executed and who holds legal title to the land or a development agreement for it; "Stakeholder" includes, but is not limited to, the Developer, the Registered Architect, the Registered Engineer, the Quantity Surveyor, the Project Manager, Local Regulatory Authorities and any other formally appointed consultant, as well as financial institutions with a secured interest in the project; "ZIA" means the Zambia Institute of Architects constituted under Cap 442 of the laws of Zambia.

  3. Application These Regulations shall apply to all Construction Sites within the Republic of Zambia where development requires the approval of a local authority and the involvement of a Registered Architect.

  4. Authority The Zambia Institute of Architects (ZIA), in exercise of its powers under CAP 442, Section 4 hereby issues the following mandatory regulations.

  5. Mandatory Site Billboards With effect from 1st January 2026, no construction works shall commence on any site requiring architectural services unless a permanent site billboard is erected and maintained in a prominent location. Therefore: (a) No construction work, excluding preliminary site clearance and soil investigation, shall commence on any Construction Site to which these Regulations apply unless a Site Billboard has been erected in accordance with the provisions herein. (b) The Developer and the Lead Consultant shall be jointly and severally responsible for ensuring compliance with this regulation. (c) The approved specifications for the Bill Board with a serialised number will be obtained from the Zambia Institute of Architects Secretariat upon application with proof of submission for planning permission and payment of a relevant application fee approved by the Council of the Zambia Institute of Architects

  1. Required Information The billboard shall clearly display the following: (a) Project Name and ZIA Registration Number. (b) Developer/Legal Owner: Full name and contact details. (c) Local Authority Approval Number for Planning Permission (d) Lead Consultant (Registered Architect): Full name, registration number, and contact details. (e) All Appointed Consultants (Engineers, Quantity Surveyors, etc.): Full names; addresses and registration numbers. (f) Appointed Contractor: Registered name, address and contact details (g) Submission of all relevant approval documents for the project (e.g permits, licences etc)

  2. Standard and Maintenance of Billboards (a) The Site Billboard shall be of a permanent and durable material. (b) It shall be erected in a conspicuous location adjacent to the main public access point to the site and shall be maintained in a legible and good condition until the expiry of the Defective Liability Period.

  3. Enforcement and Penalties The Zambia Institute of Architects, through its appointed inspectors, is hereby empowered to inspect any Construction Site to ensure compliance with these Regulations. ZIA is mandated to enforce these Regulations. Any site found non-compliant shall be subject to: (a) An immediate fine of 10,000 penalty unit's payable to the ZIA (b) A further fine of 1,250 penalty units for each day the violation continues (c) ZIA shall have the authority to recommend to the local authority that a stop-work order be issued for any site found to be in persistent non-compliance.

The Bank of Zambia Currency Directives, 2025

IN EXERCISE of the powers contained in Sections eighteen and seventy-three of the Bank of Zambia Act, 2022, the following Directives are hereby made.

  1. Short Title These Directives may be cited as the Bank of Zambia Currency Directives, 2025.

  2. Interpretation In these Directives, unless the context otherwise requires— "aggregator" means a registered or licensed entity that collects goods from multiple domestic producers or suppliers, consolidates the goods, and sells them to foreign buyers or markets as a collective lot; "auction" means a sales event on a regulated exchange where goods are sold to the highest bidder; "Bank" means the Bank of Zambia established in accordance with the Constitution of Zambia (Amendment) Act, 2016 as read with the Bank of Zambia Act, 2022; "Bank of Zambia Kwacha/US dollar mid exchange rate" means the 09:30 hours average of the Bank of Zambia buying and selling exchange rate published on the Bank of Zambia website; "commercial bank" means a bank licensed by the Bank of Zambia under the Banking and Financial Services Act, 2017; "domestic currency" means the Zambian Kwacha and Ngwee; "domestic transaction" means a private or public transaction within the Republic that involves payment of a sum of money for the credit of a person resident in the Republic except as contained in the Schedule of Exemptions;

"enclaves of foreign governments and bodies" means diplomatic institutions, embassies and other extraterritorial organisations and bodies; "engineering services incidental to mining" means professional technical and advisory services that support mining operations, such as, exploration, drilling, blasting, and extraction, typically provided by engineers or specialised firms; "financial service provider or product issuer" means a person that provides financial services under the Banking and Financial Services Act, 2017 or issues products under the Pensions Scheme Regulation Act, 1996, Insurance Act, 2021 or the Securities Act, 2016.; "foreign currency" means— (a) bank notes and coins, other than the domestic currency, which are legal tender outside the Republic; (b) any financial instrument denominated in a currency other than the domestic currency; and (c) any instrument or mode of payment as the Bank may determine; "foreign currency liability" means a financial right or obligation of a party to a transaction, including a loan, deposit or any such claim defined by its terms to be payable in a currency other than the domestic currency; "Government" means the Government of Zambia or any other Government agency duly mandated to carry out specialised functions of Government. "market exchange rate" means a current retail buying or selling rate quoted or displayed by a commercial bank; "non-resident" means an individual or enterprise whose primary economic interests lie outside Zambia. For an enterprise, this refers to an entity that is not incorporated in Zambia, does not have a branch or affiliated enterprise within Zambia, and engages only in limited transactions with Zambian enterprises or individuals. Non-residents include tourists and transit travellers; "person" means an individual, a company or an association of persons, whether corporate or unincorporate; "settlement" means a transfer of funds or monies between parties involving domestic transactions; "specialised mining equipment" means machinery and tools specifically designed for various tasks involved in mining operations, such as, extraction, transportation, processing, and safety management; and "trade credit" means an arrangement in which a supplier allows a business to purchase goods and pay for them at a later date, usually within a specified period and often without interest.

  1. Application These Directives apply to persons and to the Government undertaking domestic transactions.

  2. Settlement (1) Settlement of payment for domestic transactions shall only be in domestic currency, except for transactions specified in the Schedule of Exemptions. (2) Settlement of payment for a domestic transaction under a contract or agreement denominated in foreign currency shall be the corresponding amount of money expressed in the domestic currency converted at the market exchange rate. Where the parties do not agree on the market exchange rate to be used, the Bank of Zambia Kwacha/US dollar mid exchangerate shall be the reference rate.

  3. Domestic Transactions with Government Where the Government is a party to a domestic transaction, neither the Government nor its counterparty shall quote, pay or be paid, demand for payment or receive payment in foreign currency, except for applicable transactions specified in the Schedule of Exemptions.

  4. Contraventions (1) A person who contravenes these Directives commits an offence and is liable, upon conviction, to a fine not exceeding two thousand five hundred penalty units or to imprisonment for a period not exceeding two years or to both. (2) Where a corporate body or an unincorporated body is convicted of an offence under these Directives, an individual who — (a) is a director of, or is otherwise concerned with the management of, the corporate body or unincorporated body; or (b) knowingly authorised or permitted the act or omission constituting the offence; shall be deemed to have committed the same offence unless that individual proves to the satisfaction of the court that the act constituting the offence was done without the individual's knowledge, consent or connivance. (3) The Bank may impose an administrative penalty not exceeding one million penalty units for a violation of these Directives.

  5. Commencement These Directives shall come into force on the date they are published in the Gazette.

SCHEDULE OF EXEMPTIONS

  1. Taxes remitted by the mining sector to the Zambia Revenue Authority through the sale of foreign currency to the Bank of Zambia at the current Bank of Zambia Kwacha/US dollar mid exchange rate or the current Bank of Zambia/Chinese Renminbi mid exchange rate, as published on the Bank of Zambia website.
  2. Tolls due in foreign currency to Government agencies.
  3. The following transactions may be settled in domestic currency or any other applicable currency: (a) Payment of a sum of money in or towards the satisfaction of an existing or a future foreign currency liability with a financial product issuer or service provider, including dividends, principal, and interest thereof. This includes: (i) Financial services denominated in foreign currency or structured with a foreign currency component and regulated by the Bank of Zambia under the Banking and Financial Services Act, 2017; (ii) Securities denominated in foreign currency or structured with a foreign currency component and regulated by the Securities and Exchange Commission under the Securities Act, 2016; and (iii) Insurance policies denominated in foreign currency or structured with a foreign currency component and regulated by the Pension and Insurance Authority under the Insurance Act, 2021; (b) Mining transactions involving: (i) payment for tolling services in the mining sector, provided one of the parties remits taxes to the Zambia Revenue Authority through the sale of foreign currency to the Bank of Zambia; (ii) inter and intra-company sale of minerals and processed mineral products, provided one of the parties remits taxes to the Zambia Revenue Authority through the sale of foreign currency to the Bank of Zambia; (iii) payment to suppliers for highly specialised mining equipment and components; and (iv) engineering services incidental to mining; (c) Payment by non-resident for tourism services offered by tourism enterprises registered under the Tourism and Hospitality Act, 2015; (d) Production, transmission, distribution, and trading of electricity; (e) Enclaves of foreign governments and bodies; (f) Exports and imports; (g) Exports of agricultural products and gemstones through aggregators and auctions; and (h) Payment by farmers to input suppliers for seeds, fertilizers, and chemicals supplied through trade credit.
