Amendments to Q.P.F. No. 1 – Owners' Form and Related Endorsements Effective January 15, 2025

The Autorité des marchés financiers has amended additional coverage 4.1 for travel expenses due to vehicle theft in Q.P.F. No. 1 – Owners' Form and eight related endorsements, raising the maximum reimbursement to $3,000 per loss with no daily cap. The revised terms now permit insureds to claim similar replacement vehicle leases, taxis, other remunerated passenger transport, and incidental costs such as gasoline and tolls. These amendments take effect on January 15, 2025, and apply to all affected insurance contracts until insurers distribute the updated forms.

Notice regarding the coming into effect on January 15, 2025, of amendments to Q.P.F. No. 1 – Owners' Form and to certain endorsements related to Q.P.F. No. 1 and Q.P.F. No. 4 – Garage Form Under section 71 of the Insurers Act, CQLR, c. A-32.1, the form and terms of insurance policies relating to the ownership or use of motor vehicles are determined by the Autorité des marchés financiers (the “Authority” or the “AMF”). The same is true for any riders (“endorsements”) that may be attached to those policies. This notice sets out the amendments made to the following forms:

  • Q.P.F. No. 1 – Ownersʼ Form
  • Q.E.F. No. 20 – Travel expenses (Section B)
  • Q.E.F. No. 20a – Travel costs (broad form) (Section B)
  • Q.E.F. No. 20b – Travel expenses and loss of income (Section B)
  • Q.E.F. No. 20c – Travel expenses and loss of income (broad form) (Section B)
  • Q.E.F. No. 4-20 – Travel expenses (Section B)
  • Q.E.F. No. 4-20a – Travel expenses (broad form) (Section B)
  • Q.E.F. No. 4-20b – Travel expenses and loss of income (Section B)
  • Q.E.F. No. 4-20c – Travel expenses and loss of income (broad form) (Section B) 1- Q.P.F. No. 1 – Ownersʼ Form In Q.P.F. No. 1, Section B, the additional coverage 4.1 Travel expenses due to theft of insured vehicle currently provides that the insurer will reimburse certain travel expenses due to theft of an entire insured vehicle, including expenses incurred for the leasing of a temporary replacement vehicle, up to a maximum of $40 a day and $1,200 per loss. As motor vehicle leasing prices have increased significantly and it has been several years since the amounts in the forms have been adjusted, the AMF is amending additional coverage 4.1 of insurance policy form Q.P.F. No. 1 to provide that henceforth • travel expenses will be reimbursed up to a maximum of $3,000 per loss for each insured vehicle and there will be no daily maximum; • the insured will have the option of leasing a vehicle similar to the insured vehicle that was stolen; • in addition to claiming any expenses for the use of a taxicab, the insured will be able to claim any expenses related to any other mode of remunerated passenger transportation by automobile; and • all additional travel expenses that would not normally have to be borne by the insured, such as gasoline expenses or toll charges, will be covered. The increase in the maximum travel expense amount per loss for each insured vehicle is intended to reflect the increase in vehicle leasing prices and changes occurring in the automobile market. In this respect, these amendments will better align the form with insureds’ needs where, for various reasons, motor vehicle rental periods are extended. 2- Endorsements Q.E.F. Nos. 20, 20a, 20b and 20c and Q.E.F. Nos. 4-20, 4-20a 4-20b and 4-20c The amendments to the additional coverage 4.1 – Travel expenses due to theft of insured vehicle under Section B of Q.P.F. No. 1 (see Section 1 of this notice), also apply to the following endorsements: • Q.E.F. No. 20 – Travel expenses (Section B) • Q.E.F. No. 20a – Travel costs (broad form) (Section B)

• Q.E.F. No. 20b – Travel expenses and loss of income (Section B) • Q.E.F. No. 20c – Travel expenses and loss of income (broad form) (Section B) Such amendments have also been made to the following endorsements related to Q.P.F. No. 4 - Garage Form: • Q.E.F. No. 4-20 – Travel expenses (Section B) • Q.E.F. No. 4-20a – Travel expenses (broad form) (Section B) • Q.E.F. No. 4-20b – Travel expenses and loss of income (Section B) • Q.E.F. No. 4-20c – Travel expenses and loss of income (broad form) (Section B) 3- Effective date of the amendments The amendments made to the following forms are effective as of January 15, 2025: • Q.P.F. No. 4-20c – Travel expenses and loss of income (broad form) (Section B) Insurers will have to apply the revised forms to insurance contracts taken out before and after January 15, 2025, until they have delivered the new versions of the forms to the insureds.
