The Prime Minister of Madagascar, acting in Council of Government, issued Decree No. 2007-395 to repeal Articles 4 and 5 of Decree No. 92-424, thereby streamlining the regulatory framework for foreign trade. All remaining provisions of Decree No. 92-424 not previously repealed by Decree No. 92-782 remain fully in force, maintaining the existing legal basis for import and export regulations. Having regard to the Constitution; Having regard to Law No. 2005-020 of October 17, 2005 on Competition; Having regard to Law No. 2006-008 of August 2, 2006 establishing the Exchange Code, repealing Law No. 67-028 of December 18, 1967 on the financial relations of the Malagasy Republic with foreign countries; Having regard to Ordinance No. 88-015 of September 1, 1988 on Export Policy; Having regard to Decree No. 88-327 of September 1, 1988 setting the implementation modalities of Ordinance No. 88-015 of September 1, 1988 on Export Policy; Having regard to Decree No. 92-424 of April 3, 1992 on the Regulation of Imports from Abroad and Exports to Abroad; Having regard to Decree No. 92-782 of September 2, 1992, repealing certain provisions of the aforementioned Decree No. 92-424 of April 3, 1992; Having regard to Decree No. 2007-022 of January 20, 2007 on the appointment of the Prime Minister, Head of Government; Having regard to Decree No. 2007-025 of January 25, 2007, amended by Decree No. 2007-120 of February 19, 2007 on the appointment of members of the Government; On the joint proposal of the Minister of Economy, Planning, Private Sector and Commerce and the Minister of Finance and Budget. DECREES:
Article 1. The provisions of Articles 4 and 5 of Decree No. 92-424 of April 3, 1992 on the Regulation of Imports from Abroad and Exports to Abroad are repealed.
Article 2. The other provisions of Decree No. 92-424 of April 3, 1992, except those already repealed by Decree No. 92-782 of September 2, 1992, remain unchanged.
Article 3. The Minister of the Interior; the Minister of National Defense; the Minister of Finance and Budget; the Minister of Environment, Waters and Forests; the Minister of Health and Family Planning; the Minister of National Education and Scientific Research; the Minister of Agriculture, Livestock and Fisheries; the Minister of Telecommunications, Posts and Communication; the Minister of Economy, Planning, Private Sector and Commerce; the Minister of Energy; the Minister of Mines; the Secretary of State in charge of Culture and Leisure, are each responsible, within their respective areas of competence, for the implementation of this Decree, which shall be published in the Official Journal of the Republic of Madagascar.
