Amendments to Two Automobile Insurance Endorsement Forms Coming into Force August 1, 2017

The Autorité des marchés financiers has amended Q.E.F. No. 8 and Q.E.F. No. 8a automobile insurance endorsement forms to clarify deductible application rules for insurers. Effective August 1, 2017, the updated forms permit insurers to select whether a deductible applies to any loss or exclusively to losses occurring during a specified vehicle use. All insurers may immediately utilize these standardized forms, which are publicly accessible on the Authority’s official website.

00 Notice regarding the coming into force on August 1, 2017 of amendments to two automobile insurance endorsement forms Under section 422 of An Act respecting insurance, CQLR, c. A-32, the Autorité des marchés financiers (the “Authority” or the “AMF”) may prescribe the forms necessary for the application of this Act and must approve the form and the conditions of insurance policies relating to the ownership or use of automobiles. In order to reflect changing practices, the Authority is amending the following two automobile insurance endorsements:  Q.E.F. No. 8 – Deductible for property damage (Section A)  Q.E.F. No. 8a – Deductible for property damage and bodily injury (Section A) The current versions of these endorsements do not allow insurers to determine when the deductible must apply. Under the amended versions, insurers will be able to choose between one of the following two options to determine when the deductible must be applied, i.e., whether:  the deductible applies to any loss; or  the deductible applies solely to a loss that occurs when the vehicle is used for a purpose specified in the endorsement. These automobile insurance forms may be used by all insurers as of August 1, 2017. The forms are available on the AMF website at www.lautorite.qc.ca under Insurance and financial planning / Insurers / Automobile insurance / AMF approved forms.
