Final Response to District Court Remand Order in Securities Industry and Financial Markets Association, et al. v. United States Commodity Futures Trading Commission

The Commodity Futures Trading Commission issued this final response to a District Court remand order requiring it to address inadequacies in its cost-benefit analysis for eight swaps-related rulemakings. The Commission evaluated public comments regarding the extraterritorial application of these rules and concluded that its original analysis reasonably considered both domestic and foreign costs and benefits. Consequently, the Commission determined the remanded rules are legally sound and will not propose substantive changes in response to the remand.
